A 7-year-old lemonade stand operator has been put out of business by the New York State Health Department.

The shutdown occurred after vendors at a nearby county fair complained he was undercutting their price, according to the New York Post.

The young entrepreneur, Brendan Mulvaney, was selling lemonade, water and Sno-cones from the porch of his family’s home, which just so happens to be right outside the Saratoga County Fair in upstate New York.

A woman wearing a Health Department T-shirt turned up Friday and shut it down because the family didn’t have a permit.

Officials have gone back and forth on the issue, first saying the Health Department doesn’t regulate lemonade stands and even issuing an apology.

“We are working to better understand the situation but in the meantime want to assure the community that DOH does not issue permits for or oversee lemonade stands”, spokeswoman Jill Montag told the Post.

Twenty-four hours later, in an about-face, a permit was required after all.

The permit costs $30 and is good for a year.

The agency said it would help the family get the permit.

The youngster was charging 75 cents a cup for pre-mixed lemonade, while fresh-squeezed at the fair was going for about $7.

There was no immediate comment from Gov. Andrew Cuomo’s office.

Just $30? That's a bargain if I ever heard one. Maybe I'll get one just for fun to add to my permit collection.

I'm calling bullshit. They aren't making the family pay a fine, for not having a permit?

If this wasn't national news, they'd be fining the shit out of them for running an unlicensed establishment. Where's the justice?

They should give them the license but make them give all monies received to the Police Benevolent Association. Register them as a charity.

Another perfect example of established businesses of exploiting Govt to prohibit competition. Why? It enables a Monopoly / Less Competition and they can profit more. The Free Market would impose Price Caps via competition, which stands in the way of higher profits. If a child running a lemonade stand is an actual threat to the profit margins of established businesses, then those businesses have bigger problems than just competition from children. Perhaps they would do better to address those bigger problems first instead of blaming children for hurting their bottom line.

New York Gov. Andrew Cuomo (D) also reached out to the family and said he reached a resolution with the Mulvaneys to ensure the lemonade stand can continue to operate.
"Today I directed the Department of Health to reach a resolution with the Mulvaney family to ensure that Brendan's Lemonade Stand can continue to operate," Cuomo said in a statement (https://www.governor.ny.gov/news/statement-governor-cuomo-committing-personally-pay-any-fees-brendans-lemonade-stand). "If a permit is needed, I will personally pay for any necessary fees. We support Brendan's entrepreneurial spirit and wish him the best of luck."

Fake news. They're just shutting down this lemonade stand to negotiate the opening of more lemonade stands. There will be more lemonade stands in the end. This is how negotiations happen.
