View Full Version : Papa John's founder becomes unperson at his own company for uttering The N Word

Fired, disgraced, forced to issue a groveling apology...that's all expected.

But, in a move that Stalin would approve of, they actually purged his image from the company logo and all associated wrappers and boxes and such.

All because he dared to utter The N Word...in what appears to be a circumstance of trying to establish boundaries over when The N Word can be said or not.

ETA - Yes, that's what appears to have happened...he spoke up honestly at some sensitivity workshop bullshit, instead of quietly sitting back and mouthing the words the zampolit wanted to hear.

Papa John's logo to change after founder uses N-word

Mr Schnatter will no longer appear on Papa John's pizza boxes and other marketing material

Papa John's founder John Schnatter will be removed from the pizza chain's branding after his use of the N-word forced his exit from the company.

Mr Schnatter, the company's former chairman, had used the racial slur in a conference call in May.

A Papa John's spokesperson confirmed to the BBC that it will erase its founder's image from all advertising.

Mr Schnatter quit as chief executive last year after criticising the NFL over players' national anthem protests.

Shares in Papa John's were up more than 3.1% on Friday following the news of the branding overhaul, improving further on the gains made after it was announced that Mr Schnatter was departing as chairman.

In a statement on Wednesday, the company said it condemned "racism and any insensitive language".

The pizza chain later said it had accepted Mr Schnatter's resignation and that a new chairman would be appointed in the coming weeks.

Mr Schnatter's resignation as chairman was announced earlier this week

Papa John's is the world's third-largest pizza chain, with more than 350 outlets in the UK and 4,900 restaurants worldwide.

The slur occurred during a media training conference call in May between top staff at Papa John's and a marketing agency called Laundry Service.

According to Forbes, the call involved a role-playing exercise that was supposed to give Mr Schnatter experience in dealing with difficult issues.

When discussing how he would distance himself from racist groups, Mr Schnatter said that Colonel Sanders, the founder of KFC, had never faced criticism for using the N-word, Forbes reported.

(That "teaching" session taught a very valuable lesson. If Schnatter wasn't a "racist" before he more than likely is one now. - AF)

You should be able to to get something like a bowl that just has the toppings over cheese and sauce.

As weird as that sounds, I think the crust has to many Carbs and usually awful for digestion.

Meh, all that chain pizza is hog slop as far as I'm concerned.

I'm sick of the double standard and the "unpersoning".

Some crapper can hoot ni gger ni gger ni gger (and no, don't give me any ebonics bullshit about "ni gga" somehow being different than "ni gger") a thousand times, along with all other manner of insensitive slurs towards women and god knows who else, and they get a grammy.

This guy was a CEO who took good care of his employees, started a business from nothing, and was a limited government "liberty guy".

All gone, not for directly insulting someone, but for using A Forbidden Word in a honest conversation about when The Forbidden Word can be said.

What a bunch of horseshit.

Embattled pizza chain Papa John’s on Friday moved to erase the memory of founder John Schnatter — literally.

The chain, with 5,212 locations, said it would remove the 56-year-old executive’s likeness from its logo, promotional materials and other marketing efforts, days after he drew heat for using the N-word during an inter-company conference call.

In addition, Major League Baseball has discontinued its Papa Slam promotion with the Louisville, Ky.-based company, and at least 12 MLB teams — including the Yankees and Mets by Friday — dropped local sponsorships.

Also on Friday, the University of Louisville said it would remove Schnatter’s name from its football stadium.

The blowback from the remarks seems to have troubled investors. Papa John’s shares dipped 12 cents on Friday, to $53.55, after rising sharply one day earlier when Schnatter stepped down as chairman of the company.

“In response to the reprehensible remarks made by Papa John’s founder and owner, the New York Yankees are suspending their relationship with the company,” the franchise said in a prepared statement.

Said the Mets, “The highly offensive comments by the founder of Papa John’s are completely inconsistent with our values. We immediately suspended promotional activities with the sponsor prior to our game Wednesday night.”

The 34-year-old pizza chain plans to hire an independent expert to audit all the company’s processes, policies and systems related to diversity and inclusion, Chief Executive Steve Ritchie said in a statement.

Ritchie stressed that the chain, with 120,00 employees and franchise “team members,” is more than just Schnatter.

Eric Schiffer, who works with Fortune 500 companies and CEOs on overcoming crises, told The Post that the company is making the right move in distancing itself from the executive.

“They need to take John Schnatter, and put him in the SpaceX rocket and send him to Mars,” Schiffer said. “His face is radioactive; it’s the kiss of death.”

On Friday afternoon, Schnatter, in an interview on WHAS, a Louisville radio station, said he was pressured to use the N-word during the conference call.

“The agency was promoting that vocabulary … They pushed me. And it upset me,” he told host Terry Meiners.

“It’s caused a lot of grief for my community, for my university,” Schnatter noted. “My employees are distraught, they’re crushed, and it’s all because I was sloppy and I wasn’t as sensitive. It’s the same mistake I made on the NFL comments.”

The executive caught flak in January when he said Papa John’s, a longtime NFL sponsor, saw its sales get dinged because of the league’s players’ national anthem kneeling protest.

Those comments led to him stepping down as CEO — and the NFL cutting ties to the chain.

Sunny Bonnell, chief executive of branding agency Motto, said that after some “knee-jerk” reactions by the chain and rebranding, things should settle down.

Despite the damage and Schnatter’s toxic state, Schiffer believes the turmoil will blow over and the chain will be OK.

“No one is going to care about this in a month,” Schiffer said.

July 16, 2018

Last week, John Schnatter, the founder of Papa John's pizza chain, was forced to resign after it was leaked to the media that he used the N-word during a conference call in May. Telling his side of the story in an exclusive interview with WLKY News, Schnatter remained apologetic for using the word, but explained that the word was said as an example of racism and not in a derogatory fashion. He also said that he felt "provoked" into using the word and claimed the media agency on the conference call tried to blackmail him for $6 million over the incident, to which Schnatter replied, "I'm not for sale."

"It doesn't matter the context," Schnatter told WLKY News. "The fact of the matter is that word hurts people. It was a strategy session, it was training. ... I was just repeating what somebody else said. I was actually kind of provoked a little bit."

Schnatter says marketing agency Laundry Service attempted to get them to partner with a third party, which has used the n-word.

"This other party used that word a lot," explained the founder, adding, "By the fourth or fifth pass, I just said, 'No, we're not gonna be part of any such thing. So-and-so used the n-word, and we don't use the n-word, and we're not gonna use the n-word. And that's it.' So, we kind of shut that down quickly."

According to a report from Forbes, during the conference call, Schnatter said "Colonel Sanders called blacks n*****s" and explained that Sanders did not receive similar backlash from the public. The media company was supposed to be helping Papa John's with their public relations.

Two weeks after the call, Laundry Service "tried to extort us," says Schnatter.

"They wanted 6 million dollars to make it go away. ... The words were, 'If I don't get my effing money, I'm gonna bury the founder,' said one of the executives. I'm not for sale."

The company then "ran to Forbes" and the story went viral, Schnatter said.

The founder also hit the media for lying about the incident — something he said he expected — but noted that he was disappointed in local leaders for "caving."

"You know Forbes is gonna lie. You know The Courier is gonna lie," he said. "But you think there would be something solid in these leaders and embrace what really went down."

"I don’t condone racism in any way. Period. It’s just wrong," said Schnatter.

Papa John’s Evicts Founder from Corporate Offices

https://www.breitbart.com/sports/2018/07/16/papa-johns-evicts-founder-from-corporate-offices/

16 Jul 201822

Papa John’s founder John Schnatter is still suffering fallout from his use of the n-word as his company continues its campaign to distance itself from him, this time evicting him from his offices at the company headquarters.

In a recent meeting of company officials, a board of independent directors announced the termination of Schnatter’s agreement to be the face of the company and began the process of removing him from all advertising materials, Bloomberg reported.

Schnatter already resigned as the company’s chairman on July 8, but he still has a place on the board and owns about 30 percent of the company’s stock shares.

His woes inside the pizza chain he founded are part and parcel with the backlash he faces in other venues. In one case, Schnatter’s name was also removed from the University of Louisville’s football stadium.

Schnatter’s hometown of Jefferson, Indiana, also removed his name from a basketball gym and his photo was removed from the city’s Wall of Fame.

Schnatter resigned from his company on July 12 after taking flack for using the n-word during a training session on workplace behavior. During the conference call, the pizza chain founder observed that Colonel Harlan Sanders of Kentucky Fried Chicken fame — who died in 1980 — used the n-word and no one ever came down on him.

Schnatter maintains he was using the word in a technical sense and not using it as an epithet.

Regardless, Papa John’s has had an unexpected downturn that started even before the flap over Schnatter’s comments. Papa John’s sales dropped 5.3 percent in North America, Bloomberg noted.

“We know we can do better and I’m confident that we will,” CEO Steve Ritchie said in May. “We expect sales to improve later this year as our new marketing and technology initiatives roll out.”

Rand Paul says he won't return Schnatter's donations after racial slur

Thomas Novelly
July 16, 2018

U.S. Sen. Rand Paul said Monday he would not return thousands of dollars in political donations from John Schnatter, who resigned from Papa John's last week after he admitted to using a racial slur.

"I think the language that was said to be used was unacceptable and should not be used, period," Paul said after telling the Courier Journal he would not return the donations.

The Kentucky Republican received $17,000 from Schnatter in political donations from 1996 to 2018, according to a Courier Journal analysis of the pizza baron's FEC filings.

"Perhaps we should ask the same question of all the media covering this story: Are any of the TV stations or newspapers going to give back the advertising money they have taken from Papa John's over the years?" said sokesperson Kelsey Cooper said in a statement.

Papa John’s Founder Now Calls Resignation a ‘Mistake’

https://www.breitbart.com/big-government/2018/07/17/papa-johns-founder-now-calls-resignation-mistake/

17 Jul 2018

John Schnatter said “it was a mistake” to resign after being asked to step down in the wake of a controversy about his use of a racial slur.
In a letter to the company directors dated July 14, Schnatter said that he was asked during media training whether he was racist, and answered “no.” Then, “I [said] something on the order of, Colonel Sanders used the word ‘N,’ (I actually used the word), that I would never use that word, and Papa John’s doesn’t use that word.”

“The board asked me to step down as chairman without apparently doing any investigation. I agreed, though today I believe it was a mistake to do so,” Schnatter said. “I will not allow either my good name or the good name of the company I founded and love to be unfairly tainted.”

Schnatter is “confident that an examination of the facts will bear out what I have written in this letter,” and that it will “show that once again our company has demonstrated that it does not know how to handle a crisis based on misinformation.”

The pizza mogul has retained Los Angeles trial attorney Patricia Glaser, who requested that the board appoint a special committee to investigate the matter. According to an anonymous WSJ source, however, the request was made while such a committee was already being formed.

For now, the company is pushing Schnatter firmly away. He is no longer permitted to use office space in the Louisville, Kentucky headquarters, nor will he continue his role as a mainstay of their marketing efforts. His current share of the company is roughly 29%, valued at an estimated $500 million.

This is what happens when you apologize, there is no forgiveness, they close in for the kill:

The chief executive and a second high-ranking executive at the pizza chain — pals of Schnatter whom he installed in key positions — failed to curb a “bro” culture at the Louisville, Ky., business that featured open discussion of “gangbangs” and other hostile terms, a report on Thursday claims.
Women in the office were often mocked, asked during business conversations if they were menstruating and were subjected to comments from male executives about whether they wanted “to jump on the train,” according to a report from Forbes (https://www.forbes.com/sites/forbesdigitalcovers/2018/07/19/the-inside-story-of-papa-johns-toxic-culture/), which interviewed 37 current and former employees.
CEO Steve Ritchie was present for many of the toxic comments and just laughed, three employees told Forbes.

Over Schnatter’s tenure, Papa John’s has agreed to two confidential settlements after he was accused of inappropriate conduct, Forbes reported.

Its board has formed an independent committee that has hired an outside firm to probe the matter.
But the problem may be larger than just the 56-year-old executive.
Without addressing the specific allegations, Papa John’s issued a statement repeating its promise from earlier in the week to retain “an outside firm to oversee an audit and investigation of the culture at the company and to make recommendations for whatever changes may be necessary.”
Schnatter’s lawyer, Patricia Glaser, said the Forbes story contains “inaccuracies and misrepresentations.”
Glaser did not elaborate.
Schnatter is squaring off with his fellow directors — demanding key emails and correspondences so he can better defend himself against possible litigation and the company’s efforts to get him off the board.

The pizza chain Papa John (https://markets.businessinsider.com/stocks/pzza-stock?utm_source=yahoo&utm_medium=referral)'s has adopted a so-called poison pill designed to prevent the company's founder, John Schnatter, from taking over the company.
Schnatter resigned as the chairman of the board (https://markets.businessinsider.com/news/stocks/papa-johns-john-schnatter-resigns-as-chairman-n-word-conference-call-2018-7-1027360596?utm_source=yahoo&utm_medium=referral) this month after he admitted to using a racial slur during a May conference call with a marketing agency. Days later he said he made a mistake resigning (https://www.usatoday.com/story/money/nation-now/2018/07/18/john-schnatter-mistake-resign-papa-johns-pizza/795214002/) from the position. He still owns 29% of the company, according to Bloomberg data, and remains a director on its board. He stepped down as CEO at the beginning of the year.
In a press release (https://ir.papajohns.com/news-releases/news-release-details/papa-johns-adopts-limited-duration-stockholder-rights-plan) out Sunday, the company's board of directors announced a plan aimed at preventing Schnatter from taking over the pizza chain. It created a limited-duration stockholder rights plan the board said was designed to "protect the interests of the company and its stockholders by reducing the likelihood that any person or group gains control of Papa John's through open market accumulation or other tactics without paying an appropriate control premium." The board also declared a dividend distribution for each share of outstanding stock.

Investors reacted angrily on Monday to the poison pill Papa John’s board enacted over the weekend (https://thenypost.wordpress.com/2018/07/22/papa-johns-board-oks-poison-pill-to-block-founder-from-gaining-control/) — pushing the stock of the pizza maker to its lowest level since February 2016.
Shares lost 9.8 percent in the session to close at $46.56. In the past month, the *$1.5 billion Louisville, Ky., firm has lost *$300 million in market cap.

Under the poison pill, shareholders will receive the right to one preferred share for every share they own. The right will be triggered when someone buys a 15 percent stake in the company without the board’s OK.
Schnatter’s current stake is grandfathered in. The 56-year-old founder had been a highly visible spokesman for the 5,212-store chain — appearing in TV commercials and even in the company’s logo.

The founder of the Papa John's pizza chain filed a lawsuit Thursday seeking access to the company's books and records following his resignation as chairman earlier this month amid reports that he used a racial slur during a media training session. In a complaint filed in Delaware's Court of Chancery, John Schnatter accused Papa John's International Inc. of treating him in an "unexplained and heavy-handed way" after Forbes published a July 11 article that he says falsely accused him.
Instead of standing behind him and trying to explain what actually happened, the company followed "its usual, and flawed, manner of dealing with false and mistaken reporting," Schnatter claimed.
Schnatter compared the board's request that he step down as chairman to its prompting of his resignation as CEO last year amid controversy over remarks he made regarding National Football League players protesting during the national anthem.
In the complaint, Schnatter says company directors either acted in a hasty and uninformed manner, thus breaching their duty of care to the corporation, or had secretly planned a "coup" in advance to oust him.
"Either way, as a director of the company, Mr. Schnatter is entitled to determine whether his fellow directors have been grossly negligent or are acting in bad faith, or both," the complaint reads.
Schnatter filed the lawsuit after the company rebuffed his July 18 request for a variety of documents, saying he was seeking to further his own self-interests, rather than the company's best interests.
The documents Schnatter seeks include internal communications by directors, officers and attorneys relating to him from Oct. 31 last year through July 15, when a special committee was formed to address the Forbes article. Schnatter is also seeking documents relating to any allegations of sexual harassment or sexual misconduct by any board member or officer.

Papa John's is going to extreme measures to erase all evidence founder John Schnatter ever existed from its 5,212 location pizza chain, sending detailed instructions its store owners on how to remove every shred of the former Chairman.
https://www.zerohedge.com/sites/default/files/inline-images/disappearing%20schnatter.jpg

Store owners should remove Schnatter’s signature from the wooden paddles used to take pizzas out of the oven — and replace it with images of vegetables or cheese — and swap out window signs featuring a smiling Schnatter with online ordering signage, according to the seven-page email, a copy of which was obtained by The Post.
A total of 10 items to be removed include a wall poster of Schnatter and NFL great Peyton Manning and even signage on Papa John’s pickup trucks. -NY Post (https://nypost.com/2018/08/01/papa-johns-orders-stores-to-purge-all-reminders-of-founder/)
Also to be removed are plaques hanging on the walls with Schnatter describing how their pizzas are made - replaced with photos of a dough maker with the caption "our FRESH DOUGH story."

Franchisees are told they can replace the photos of Schnatter’s beloved gold Camaro with one of two options featuring a Garden Special veggie pie or one called The Works.
“In most cases the Camaro plaque can be unscrewed and the plaque screwed back in,” the company helpfully advises.
Franchisees are instructed to remove the cutouts of Schnatter and Manning, which include a “Welcome to our Stores” banner, but are told that “there is no replacement for this item.” -NY Post (https://nypost.com/2018/08/01/papa-johns-orders-stores-to-purge-all-reminders-of-founder/)

Speaking of... how about we embrace freedom of speech and let people say whatever the hell they want without a mob of offended people shutting them down? Yes, you are free to be a racist. I’ll say it again: You are free to be a racist. And you are free to run your business as a racist. If you don’t want nigg ers working for you, then don’t hire them. It’s called freedom. Nobody is owed a job. Start your own fucking nigg er business, nigg er!

People’s feelings aren’t protected by the constitution. They can go somewhere else for pizza if they don’t like it. Racism exists everywhere in all walks of life. If someone says they hate white people, I don’t get offended. I’ve been the victim of racism in the workplace. Did I try to take the company down? No. I quit my job and found another company whose management didn’t hate whitey. Fuck em.

Better ingredients, better pizza, no nigg ers. Papa John’s.

The Papa John's PZZA Pizza saga has reached new heights.
John Schnatter, the chain's founder, has created a website stating, "We are getting the truth out there," and is running a full-page ad in the Louisville Courier Journal on Wednesday telling employees how much he misses them.
The Save Papa John's website includes legal documents relating to Schnatter's feud with the board of the pizza chain, which has removed his "Founders Agreement" from its site, has taken him off marketing material and stopped him from using corporate headquarters.
The Papa John's board acted after Schnatter appeared on Louisville television claiming that PR agency Laundry Service tried to extort $6 million from the pizza chain. Schnatter filed a lawsuit against the board on July 26, accusing it of negligence.
Under the headline "I am Papa John," Schnatter states on his website that he loves the company and its employees. "I built Papa John's from the ground up and remain its largest shareholder… The board wants to silence me. So this is my website, and my way to talk to you."
A letter to staff denies that Schnatter wanted his image removed from offices and marketing. "This is not the case at all. As you all know, Papa John's is our life's work," he wrote.

Earlier Thursday, a shareholder sued the struggling pizza chain, claiming it misled investors by failing to disclose inappropriate behavior by its executives, including Schnatter’s.
The pizza chain is facing slowing sales following Schnatter’s resignation as chairman last month. Papa John’s shares have fallen 18 percent this year and 39 percent in the past 12 months. They fell 58 cents to $45.96 at 2:38 p.m. in New York trading.
Joanne E. Danker sued in Manhattan federal court, alleging that Louisville, Kentucky-based Papa John’s failed to tell investors that executives had engaged in sexual harassment and other inappropriate conduct -- and that company policies were inadequate to prevent the behavior.

On Friday, Schnatter sued (https://finance.yahoo.com/news/founder-sues-papa-johns-board-143023957.html) the Papa John’s board and CEO Steve Ritchie, “to stop the irreparable harm those individuals are causing.”

This week, a special committee from Papa John’s released a blistering statement about Schnatter (https://money.cnn.com/2018/08/29/news/companies/papa-johns-letter-nfl/index.html), accusing him of untrue statements, undermining the company, and revealing that the Papa John’s board “specifically directed John Schnatter not to talk about the NFL controversy related to the National Anthem on the 2017 third-quarter earnings call.”
Schnatter, on that fateful earnings call in November 2017, blamed Papa John’s flat quarterly sales on the NFL protests and said the protests should have been “nipped in the bud” by the NFL (https://finance.yahoo.com/news/nfl-protests-led-papa-john-schnatters-downfall-203838856.html) much sooner.

Papa John’s could unveil a new – but not too new – name and logo in the coming months.
The pizza chain may soon get rid of its apostrophe, and go by Papa Johns, in an effort to repair its tarnished image (http://fortune.com/2018/07/13/papa-johns-logo-john-schnatter/) after its founder reportedly made a racist remark earlier this year during a conference call. John Schattner, founder and the company’s face, resigned as chairman (http://fortune.com/2018/07/17/papa-johns-founder-john-schnatter-says-he-shouldnt-have-resigned-over-racial-slur/) in July 2018.
Papa John’s International filed paperwork about the new spelling and brand imagery with the U.S. Patent and Trademark Office in late August. Removing the possessive apostrophe in Papa John’s would, in theory, provide a more distance between the company and its founder, so it doesn’t look like he owns the business.

Papa John's founder John Schnatter is leaving its board of directors as part of a settlement resolving a bitter dispute for control of the world's third-largest pizza chain. The company said in a regulatory filing on Tuesday it would co-operate with Schnatter to find a mutually acceptable independent director who would not be affiliated with Schnatter or hedge fund investor Starboard Value LP, which owns a nearly 10 percent stake in the restaurant chain.
Schnatter, who owns about 30 percent of the company's shares, would resign from the board if the independent director is appointed before the annual stockholder meeting slated for May, Papa John's said. Schnatter stepped down as chairman last summer, following reports he had used a racial slur on a media training conference call.
Schnatter has filed several lawsuits against the company in a bid to regain control of the company he founded in his father's tavern. In January, he claimed a victory when a court ordered the board to give him some internal documents, including text messages related to his firing, which Papa John's had until then refused to share.
After learning that Papa John's would not nominate him to its board this year, Schnatter last Friday submitted a letter nominating himself, according to a regulatory filing and a person familiar with the matter. The moves laid the groundwork for a costly and distracting proxy battle that the settlement now helps avoid, the person said.

As part of the agreement, Papa John's has agreed to share with Schnatter all of the company's records, giving him the option to sue if those documents revealed wrongdoing by the company, Schnatter said in a statement
Schnatter, in return, has agreed to dismiss lawsuits he filed against the company.
"(I am) thankful that I've been able to resolve these important issues, and that we can all focus on the company’s business without the need for additional litigation," Schnatter said.
The restaurant chain agreed to remove a provision of a poison pill, a stockholder rights plan that can dilute shares, preventing Schnatter from speaking with other shareholders about the company.
Papa John's also agreed to relinquish the requirement that Starboard vote in favor of the incumbent board.

John Schnatter (https://www.bizjournals.com/louisville/search/results?q=John Schnatter) unloaded even more of his Papa John’s International Inc. shares this week.
According to a Thursday Securities and Exchange Commission filing, the founder and former CEO of the Louisville-based international pizza chain sold 199,483 shares at nearly $51 per share, for $10.1 million, in a span of two days.
The latest sale comes after Tuesday’s SEC filing (https://www.bizjournals.com/louisville/news/2019/05/14/schnatter-unloads-millions-in-papa-johns-shares.html), which indicated Schnatter had sold 114,061 shares for more than $6 million a week after announcing his intent to sell his stake (https://www.bizjournals.com/louisville/news/2019/05/07/schnatter-exploring-sale-of-papa-johns-stake.html) in the Louisville-based company.
Schnatter has only sold a fraction of his more than 9 million shares, which is still a 30 percent stake in the company. Based on the current sale price per share, he would net about half a billion dollars if he chooses to sell his entire stake.
That process will most likely be a slow one, said Jim Gordon (https://www.bizjournals.com/louisville/search/results?q=Jim Gordon), an analyst with Pacific Management Consulting Group, who tracks Papa John's.
Schnatter is “testing the waters in anticipation of an orderly withdraw,” Gordon said. “John owes a duty — not only to his own shares that he wants to get out without collapsing [them] because of the fairly contentious relationship [with the company] — he owes a duty to the rest of the shareholders not to collapse the share price.”
On Friday, Papa John’s (https://www.bizjournals.com/louisville/search/results?q=Papa%20John) price per share was hovering near $48, a slight decrease from the $51 from earlier this week.

Schnatter also recently left the board of directors after an agreement (https://www.bizjournals.com/louisville/news/2019/03/05/papa-johns-reaches-settlement-with-schnatter.html) that would allow him to collaborate with the company to name a new director. This new filing says Schnatter and Papa John's have engaged in discussions regarding candidates for such role but have come to no decision.

Today, John Schnatter, the iconic founder and former brand spokesman for Papa John's International, announced the filing of a lawsuit in Louisville, Kentucky against the creative advertising firm, Laundry Service, and its parent company, Wasserman Media. The claims stem from a secretly-taped meeting led by Laundry Service in May 2018, some details of which appeared in a salacious news story in Forbes falsely reporting that Mr. Schnatter used a racial slur against African Americans. In truth, during the conference call, Mr. Schnatter actually expressed his disdain for racism and criticized a well-known figure who reportedly used racial slurs. The recording of the call proves Schnatter said that he himself "never used that word," which contrasts sharply with the false narrative reported in Forbes.
The complaint also highlights a commercial dispute between Laundry Service and Papa John's International in which Casey Wasserman, the CEO of Laundry Service's parent company, told Papa John's then-CEO Steve Ritchie that he would "bury the founder" if Laundry Service was not paid $6 million. Subsequently, excerpts from the conference call with Laundry Service were leaked to Forbes.
The suit filed in court today seeks unspecified damages for three counts, including Breach of Contract, Tortious Interference with Prospective Economic Advantage, and Intentional Infliction of Emotional Distress. Mr. Schnatter has pledged to contribute all net proceeds from this lawsuit to charity.

A federal court unsealed a complaint that alleged a "secret plot" against the former CEO of Papa John's Pizza, John Schnatter, that leadership at ad agency Laundry Service, including former CEO Jason Stein, conspired to make the pizza chain founder look racist and damage his brand.

https://cms.thepostmillennial.com/content/images/2021/03/Untitled-design---2021-03-03T195631.789.jpg

According to the compliant (javascript:void(0)), which was ordered to be unsealed by the US District Court for the Western District of Kentucky, the branding company hired which was hired by Papa John's to improve its image, was caught on a "hot mic" brainstorming ways in which it could use comments made by Schnatter to damage his image.

Jason Stein, Laundry Service's CEO at the time, discussed how he hoped Schnatter “gets f***ing sent out to the pasture with this s**t." The complaint alleged that Stein, and the other employees at Laundry Service, planned "to have an hourlong live interview with a hostile media personality" hoping the former CEO would make damaging statements that could go viral when taken out of context.
According to Schnatter, who released the unsealed document and a statement on Wednesday, the conversation was taped by a witness in the litigation. "The chilling details from this taped conversation make clear the intent of Laundry Service to destroy my reputation, as well as the Papa John’s brand, harming our employees and franchisees in the process."
According to Schnatter’s statement, a former Laundry Service employee present at the conversations testified that "this did not seem part of the efforts to maintain – to help John’s reputation to do the job that we were paid for to help … [this seemed like] the opposite of helping John." Schnatter added that the employee provided the recording to Laundry Service’s HR department and was told to delete it.
