The Justice Department filed suit against a Colorado company Thursday ​saying it discriminated against American workers​ by hiring seasonal foreigners instead.​

The Loveland-based Crop Production Services Inc. refused at least three US citizens work in 2016 because ​it​ preferred to hire temporary ​workers with H-2A visas, according to​ the​ Justice Department.
The Crop Production Services case is the firs​​t federal prosecution since ​President ​Trump’s America First executive order signed on April 18 (https://www.whitehouse.gov/the-press-office/2017/04/18/presidential-executive-order-buy-american-and-hire-american) that urges the enforcement of all buy American and hire American laws and regulations.
There was one previous settlement in May against an onion farm in New Mexico accused of preferring foreign visa holders. Settlement negotiations with Crop Production Services broke down, necessitating the formal suit, according to a Justice Department official.
“In the spirit of President Trump’s Executive Order on Buy American and Hire American, the Department of Justice will not tolerate employers who discriminate against U.S. workers because of a desire to hire temporary foreign visa holders,” Attorney General Jeff Sessions said in a statement (https://www.justice.gov/opa/pr/justice-department-settles-us-worker-discrimination-claims-against-new-mexico-farm).


The Justice Department alleges American workers were denied work as technicians (https://www.justice.gov/opa/press-release/file/999756/download?utm_medium=email&utm_source=govdelivery) at the rice breeding facility in El Campo, Texas in 2016 and gave all 15 available jobs to immigrant seasonal workers. The US workers were subject to a more “onerous hiring process” than H-2A workers, such as drug tests, background tests and English proficiency, according to the complaint.
Crop Production is being hit with an alleged violation of the Immigration and Nationality Act, which makes it unlawful for employers to intentionally discriminate against Americans because of their citizenship. The H2-A visa program also mandates employers to first seek out available US workers, according to the Justice Department.

President Trump's Mar-a-Lago Club in Florida has asked permission to hire 70 foreign workers this fall, attesting — in the middle of the White House's “Made in America Week” — that it cannot find qualified Americans to serve as cooks, waiters and housekeepers.

Those requests were made to the Department of Labor in recent days and posted online Thursday. The for-profit club, where Trump spent numerous weekends this spring, asked permission to hire 15 housekeepers, 20 cooks and 35 waiters.

In addition, Trump's golf club in nearby Jupiter, Fla. asked permission to hire six foreign workers as cooks. The applications to the Department of Labor are a first step in the process of applying for H-2B visas, which would allow the clubs to bring in foreigners for temporary work between October and next May.

Great Americans follow great American rules. Great Americans use their money and political influence to write great American rules. So, obviously, if they followed the great American rules, that they helped to create, then they are making America great again!

Whether you and I agree on the question of if these rules are right or not, zippy is trying to claim Trump is somehow a hypocrite and that is not true.

Are you going to tell me that there are no American housekeepers, cooks and waitstaff to be had? I've worked at one time or another in all three positions.
The business managers at Mar A Largo are looking at the bottom wage line. Look at Disney World and what happened to their IT staff. Big business is decidedly Un-American worker when it comes to the bottom line.

I never claimed the rules were perfect, I am not here to defend the rules, you and I have disagreed about immigration elsewhere but I don't feel like arguing about it right now, my point was that zippy is trying to compare someone who followed the rules to someone who didn't and it is simply wrong.

So your argument comes down to "If you follow the rules it is right, if you don't follow the rules it is wrong. Regardless of whether or not the rules are right in the first place?"

No, I have not said anything about "Right", I pointed out that zippy's attack was unfair, if zippy or you think that the rules are wrong then go ahead and say that, I am not well versed enough on the labor market to argue about these guest worker laws in detail so I won't respond other than to say that Americans have a right to control immigration and guest worker visits.

I don't want to have that fight right now so this is the last I will say for now.

That seems to be the mentality everywhere, that's where the big push to bring capital back by lowering taxes and build missile defense systems. Progressives everywhere are arguing for isolationism to mitigate the breakdown of global systems from manufacturing and food production and energy production to other countries. Progressives are afraid of global catastrophes that cause a breakdown of systems like food production and energy production and manufacturing. Progressives everywhere are gearing up for a world war some of them Progressives think that the rising tides are going to push a billion refugees everywhere and its probably the real reason why Trump wants to build a wall.
