WASHINGTON (AP) — The Latest on ongoing investigations into Russia’s alleged interference with the U.S. election (all times local):

9:30 a.m.

Former National Security Adviser Michael Flynn will invoke his Fifth Amendment protection against self-incrimination on Monday as he notifies the Senate Intelligence committee that he will not comply with a subpoena seeking documents.

That’s according to a person with direct knowledge of the matter. The person spoke on condition of anonymity to discuss the private interactions between Flynn and the committee.

Flynn’s decision comes less than two weeks after the committee issued a subpoena for Flynn’s documents as part of the panel’s investigation into Russia’s meddling in the 2016 election.

Legal experts have said Flynn was unlikely to turn over the personal documents without immunity because he would be waiving some of his constitutional protections by doing so. Flynn has previously sought immunity from “unfair prosecution” to cooperate with the committee.

Probably the smart move. Nothing happens after pleading the 5th, everything just gets dropped.


Lois Lerner pleads the fifth again, doesn't testify on IRS targeting

House Oversight and Government Reform Committee Chairman Darrell Issa, R-Calif., reconvened a hearing Wednesday that began more than nine months ago to investigate whether the Internal Revenue Service (IRS) targeting conservative groups, a scandal that was exposed in 2013.

The problem was, he didn't have a witness to answer his questions - again.

Lerner once again asserted her Fifth Amendment right not to testify, as she did last May when she was first called to testify. Before she first spoke at the hearing Wednesday, Issa warned that his committee would consider whether to hold her in contempt if she declined to testify.

At the first part of the hearing last May, Lerner delivered an opening statement declaring she had done nothing wrong, and then invoked her Fifth Amendment right and refused to answer any more questions. Republicans, however, concluded she did and have recalled her to answer questions about why Lerner gave heightened scrutiny to conservative groups with the words "tea party" or "patriot" in their names when reviewing applications for tax-exempt status.

TRUMP: That was more than a mistake. That was done purposely. OK? That was not a mistake. That was done purposely. When you have your staff taking the Fifth Amendment, taking the Fifth so they're not prosecuted, when you have the man that set up the illegal server taking the Fifth, I think it's disgraceful. And believe me, this country thinks it's -- really thinks it's disgraceful, also.

Taking the fifth to avoid prosecution of a crime that was committed is different than taking the fifth to avoid being railroaded by a corrupt justice department.

A report Thursday evening about Mike Flynn looking to strike a deal with congressional intelligence committees to testify in exchange for immunity strikes a potentially awkward contrast to comments he made about President Trump's presidential rival Hillary Clinton during the heat of the election.

Speaking with NBC's Chuck Todd in September, Flynn, then an adviser the Trump campaign, questioned the innocence of Cheryl Mills and four other former Clinton aides who agreed to testify in exchange for immunity in an FBI investigation into Clinton's unauthorized email server while serving as secretary of state.

Noting an earlier statement by Clinton campaign chairman John Podesta, about how Clinton wants to make sure there is "no individual should be too big to jail," Flynn said, "That should include people like Hillary Clinton."

"Five people around her have been given immunity, to include her former chief of staff. When you are given immunity, that means you have probably committed a crime," he added. "I don't know how he can sit there and say something like that with all the things that have been going around — just swirling around Hillary Clinton with her e-mails."

During the Republican convention in July, Flynn led chants of "lock her up" during his speech. He also said: "If I did a tenth of what she did, I would be in jail."

Flynn later became a national security adviser for the Trump administration but resigned in February in response to the controversy about how he misled the administration about his communications with a Russian envoy.
