View Full Version : NH joins VT as the 2nd state with a clean Constitutional Carry law

When Governor Chris Sununun signed Senate Bill 12 into law this morning, New Hampshire joined Vermont as only the second state in the nation to have a clean Constitutional Carry law. The New Hampshire law, like as in Vermont, doesn't include a 21 or 18 year old age restriction, doesn't just apply to residents, and doesn't require a duty to report to police.

During the 2011/2012 legislative session, Republicans had super-majorities in the New Hampshire legislature. There was an effort to pass a similar law back then. However, the National Rifle Associate decided the bill was too pro-liberty and worked against it. The New Hampshire Senate throw up it's hands at the confusion and nothing passed. The NRA finally got on board with clean Constitutional Carry. In 2015 and again 2016, the exact same text passed both legislative bodies, only to be vetoed by the governor. In 2016, all of the Republican candidates for governor said they would sign the bill into law. Chris Sununu won the Republican nomination. He campaigned on passing Constitutional Carry.

In 2017, the very first bill to have a Senate hearing was SB12. The very first Senate bill to be heard in the House was SB12. The very first bill to be signed by the Governor was SB12. The law ends decades of discrimination. New Hampshire first enacted a license to restrict poor French Canadian and Irish living in New Hampshire from carrying concealed. This era government enforced discrimination is now over. New Hampshire joins border state Vermont as creating the clean Constitutional Carry region of the United States. Hopefully another or 48 more states join us ;)

Concord, NH – Governor Chris Sununu today signed Senate Bill 12, Constitutional Carry legislation, into law. Governor Sununu was joined by sponsors of the legislation and delivered the following statement:

"SB 12 ensures New Hampshire citizens are guaranteed the fundamental right to carry a firearm in defense of themselves and their families, as prescribed by Article 2a of our state constitution," said Governor Chris Sununu. "This common sense legislation aligns our concealed carry laws with that of our neighboring states of Vermont and Maine and states across the country. This is about safety. This is about making sure that the laws on our books are keeping people safe while remaining true to the Live Free or Die spirit that makes New Hampshire the great state that it is. This is a commitment I made to the people of New Hampshire and I am proud today to fulfill that commitment, signing SB12 into law."

Interestingly, the person that ran Ron Paul's New England campaign now works for the governor that signed this law, the best Constitutional Carry bill ever signed into law.

New Hampshire (and the neighboring states) has a lot better skiing than PA so winter sucks less in NH. Winter in the worst in the Midwest as the skiing is complete crap there.

You bring up a good point, though :) During winter, some people wear jackets. The difference in open and concealed carry is putting a jacket on a body.

CONCORD - With the stroke of a pen, Gov. Chris Sununu made it easier for many Granite Staters to carry concealed weapons.

In front of a large audience of Republican state lawmakers and gun rights activists, the governor Wednesday signed into law a measure repeals the need for a permit or license to carry a concealed handgun.

But a leading opponent of the new law, which takes effect immediately, warned that “we are going to see significant ramifications.”

As he signed the bill, Sununu said “it is commonsense legislation that finally aligns our concealed carry laws with those of our neighboring states of Vermont and Maine and other states across the country. This is about safety. This is about making sure that our laws on our books are keeping people safe while remaining true to that live free or die spirit that makes New Hampshire the great state that it is.”

The bill passed the GOP dominated state Senate by a 13-10 party line vote last month. Earlier this month, by a two-to-one margin, the measure easily sailed through the Republican controlled state House of Representatives.

Similar bills passed the GOP dominated state Senate and state House of Representatives the past two years, but were both vetoed by then-Democratic Gov. Maggie Hassan. Her predecessor in the Corner Office, fellow Democratic Gov. John Lynch, vetoed similar measures in 2006 and 2011.

But Sununu, the first Republican governor in New Hampshire in a dozen years, had repeatedly said he’d sign the bill into law.

"This is a commitment that I made to the people of New Hampshire and today I’m proud to fulfill that commitment in signing Senate Bill 12 into law," the governor declared.

State Senate Majority Leader Jeb Bradley told NH1 News "what the opponents of this bill forget is that it’s about protecting the rights of law abiding citizens. We've not enabled criminals to have easier access to guns, nor should we. We want to make sure that law abiding citizens are protected and that they are not judged as to whether their suitable, if they’re a law abiding citizen and entitled to own a firearm, to be able to get a concealed carry permit.”

The Republican lawmaker from Wolfeboro and former congressman, who sponsored the bill, known formally as SB12, added that "this is a long time coming, but finally it has come."

He pointed to the neighboring states of Vermont and Maine, which don’t require permits to carry concealed handguns.

"As I’ve stressed repeatedly, Vermont is the safest state in the nation, and it’s never had a permit for a concealed carry. I think New Hampshire now will become even safer. Our ranking is good, but it will be better after this," Bradley added.

And he applauded the team effort in getting the legislation passed into law.

"We were able to bring everybody together," Bradley said. "I think that various groups that support the 2nd Amendment worked hard on this language a couple of years ago to make sure it was correct, that there weren’t any technical problems in it."

A few quotes about the people that tried to stop this from happening because they are pro-crime?



Everytown even hired lobbying organizations in the state of New Hampshire to fight against Constitutional Carry and push draconian gun control bills. Moms Demand never did get any grassroots support — during big hearings on this bill they would maybe have 5 women (at least one who was nothing put a paid hack and is now a paid lobbyist by Everytown). Meanwhile, the 2nd Amendment community would pack the state house. The first bill that came to be voted on (Senate Bill 116) had over four hours of testimony (only four spoke against the bill and three of them were paid lobbyists). The 2nd Amendment community in New Hampshire is large, organized, and are willing to fight for their freedom. Everytown actually has 11 lobbyists on their payroll in the small state of New Hampshire, a state that has some of the lowest crime in the country and no gun violence issues.

The New Hampshire Association of Chiefs of Police testified each time over the course of the 2.5 year fight. Each time they lied about the bill and made up outrageous claims as to why it shouldn’t be passed. Of course, not all police chiefs are members of this organization, which is nothing but a left-wing progressive gun-control organization. Over and over again they made fools of themselves in full uniform.

The gun control lobby was flustered that women would dare fight for their 2nd Amendment rights. Democrats who claim to be for women’s rights and like to play identity politics had no idea how to deal with women demanding their rights. Democrats pretend to be against discrimination but that’s simply not true. They voted to continue the discrimination and racism that the pistol/revolver licensing law allowed. They voted how their party bosses told them rather than how their constituents wanted them to vote.

This is one of the best stories of the year. GREAT! But last time I checked, the US constitution does not say "you have a right to a firearm UNLESS you are a convicted felon". No, it just says you have a right to a firearm, period. If someone is convicted of a violent crime then it would make sense to take away a firearm right as an explicit punishment by a judge. But, barring that, felons do have a right, though not a respected right, to carry a firearm. That should be the next step in New Hampshire, for felons who have not been explicitly barred from a firearm as punishment of a violent crime to have their firearm rights respected.

Also, the state of New Hampshire should allow in-state manufacturers to issue in-state firearm silencers to those who buy one and avoid the $200 federal fee for a silencer. Actually the feds are basically attacking us the people directly and damaging our ears with that $200 fine for wanting ear protection.

All states except water it down. The most common are age such as 21, 19, or even 18. High school kids are issued pistol revolver licenses (what we call CCWs) in New Hampshire. The next most common is a residency requirement like WY, ID and I believe some other states did. ME added a duty to inform police that you are carrying a firearm if you interact with them (plus age). VT never had and still doesn't have licenses so it never watered down. NH is the first to pass Constitutional Carry and not water it down. That took a lot of work because the NRA demanded NH water it down with an age for years.
