House Speaker Paul Ryan says Republicans are taking legal steps to stop President Barack Obama from closing the U.S. prison at Guantanamo Bay, Cuba

WASHINGTON (AP) — House Speaker Paul Ryan said Wednesday Republicans are taking legal steps to stop President Barack Obama from closing the U.S. prison at Guantanamo Bay, Cuba, a day after the president unveiled his plan to shutter the facility and move the detainees to the United States.

Ryan told reporters that lawmakers have the votes to block Obama's plan in Congress and enough votes to override any veto. Separately, the Wisconsin Republican said the GOP is "preparing our legal challenge" to ensure the prison remains open and detainees aren't moved to the U.S.




Under Obama's plan, roughly 35 of the 91 current prisoners will be transferred to other countries in the coming months, leaving up to 60 detainees who are either facing trial by military commission or have been determined to be too dangerous to release but are not facing charges.

Those detainees would be relocated to a U.S. facility.

Ryan said Obama's plan flouts a longstanding ban annually passed by Congress that blocks the president from transferring Guantanamo detainees to U.S. soil.

"If the president proceeds with knowingly breaking the law ... he will be met with fierce bipartisan opposition here in Congress and we are taking all legal preparations necessary to meet with that resistance," Ryan told reporters. "He can't do it because the law is really clear. I'll just leave it at that."

The US says it has sent 15 Guantanamo Bay detainees to the United Arab Emirates - the largest single transfer during President Barack Obama's administration.

The Pentagon says the transfer of 12 Yemeni nationals and three Afghans brings the total number of prisoners down to 61 at the US facility in Cuba.

The released inmates had been held without charge, some for over 14 years.

President Obama wants to close the prison before he leaves office.

There used to be 779 prisoners there. If they are guilty of something, they should be charged and tried. If they are not guilty of anything they should not be held without trial or even charges for years and years. Congress won't let them have any trials and makes it hard to release any of them.

"The president has nobody but himself to blame for the failure to close Guantanamo," Wells Dixon, an attorney with the Center for Constitutional Rights who has defended several Guantanamo detainees, told Al Jazeera. "I hope on Thanksgiving he stops to think about the people he has stranded in his illegal offshore prison and the families that miss them terribly."

David Remes, a human rights lawyer who also represents numerous Guantanamo detainees, told Al Jazeera that transferring prisoners from one facility to another would still violate their human rights.

“It doesn’t matter that Congress has prevented him from bringing detainees to the U.S., only to hold them indefinitely in detention without charge. That’s just changing the zip code,” Remes said. “What matters is that time after time he let politics stand in the way of sending detainees back to their home countries or resettling them in other countries. That’s the great tragedy, and he has only himself to blame.”

Meanwhile, House Speaker Paul Ryan, R-Wis., said Obama's approval of the NDAA "reaffirms longstanding prohibitions on the transfer of Guantanamo Bay detainees to the United States."

To be fair, she had also said in the past that she opposed gay marriage and supported Iraq war with conviction. She also told Obama, "shame on you".
