Bundy brothers, other Oregon occupiers found not guilty on federal charges

The leaders of an Oregon occupation on trial for the weeks-long takeover of a federal wildlife refuge have been acquitted on all major charges.

A group of rifle-toting protesters led by conservative ranchers Ammon and Ryan Bundy stayed at the Malheur National Wildlife refuge near Burns for 41 days before the final demonstrators surrendered to police in mid-February.

The Bundy brothers, along with five other defendants, were charged with federal counts including conspiring to impede wildlife refuge employees and possession of guns at a federal facility.

They were found not guilty, though Ryan Bundy faces an additional theft of government property charge where a verdict has not been returned, according to the Oregonian.

The leaders of an armed group who seized a national wildlife refuge in rural Oregon were acquitted Thursday in the 41-day standoff that brought new attention to a long-running dispute over control of federal lands in the West.

A jury found brothers Ammon and Ryan Bundy not guilty of carrying a firearm in a federal facility and conspiring to impede federal workers from their jobs at the Malheur National Wildlife Refuge, 300 miles southeast of Portland, where the trial took place. Five co-defendants also were tried on one or both of the charges.

Despite the acquittal, the Bundys are expected to stand trial in Nevada early next year on charges stemming from another high-profile standoff with federal agents. Authorities rounding up cattle at their father Cliven Bundy's ranch in 2014 because of unpaid grazing fees released the animals as they faced armed protesters.

Ammon Bundy's lawyer J. Morgan Philpot, said afterwards on the courthouse steps that Mumford had been arrested and marshals had used a stun gun, or Taser, on his back. Another member of Ammon Bundy's legal team Rick Koerber, echoed Philpot, saying he heard Mumford questioning in court why they were using a Taser against him.

Philpot decried the marshals' treatment of Mumford in the courtroom. "What happened at the end is symbolic of the improper use of force by the federal government,'' he said.

By 6:30 p.m., Mumford was released from custody. He confirmed that he was struck with a stun gun once while he was on the floor of the courtroom.

"I grew up on a dairy farm, so am I used to some rough treatment, sure?'' he said. But he said the actions of the U.S. marshals were uncalled for.

"All I was asking for was papers. Just show me you have the authority to take Mr. Bundy into custody.''

As to the verdict, "Very pleased, very gratified. This jury was dedicated. They listened to our case.''

Suckling said threats and assaults against public-land employees had been on the rise.

“It’s already an incredibly difficult, dangerous job,” he said. “l feel frightened and worried for every public-land manager in America.”

"For many weeks, hundreds of law enforcement officers — federal, state and local — worked around the clock to resolve the armed occupation at the Malheur National Wildlife Refuge peacefully. We believe now — as we did then — that protecting and defending this nation through rigorous obedience to the U.S. Constitution is our most important responsibility," said Greg Bretzing, special agent in charge of the FBI in Oregon.

"Although we are extremely disappointed in the verdict, we respect the court and the role of the jury in the American judicial system,” Bretzing said.

Oregon Gov. Kate Brown said she was disappointed by the jury's decision.

"The occupation of the Malheur refuge by outsiders did not reflect the Oregon way of respectfully working together to resolve differences," Brown said. "I appreciate the due diligence of our federal partners and stand with the communities of Harney County and residents of Burns."

So then nearly a year has passed and we are still of the sordid mindset that:

1. It is illegal to gather in a group to demand public redress by governmental leaders.
2. The federal government may legally retain possession and control up to 100% of the lands prior designated within the boarders newly formed states.
3. It is a federal crime to possess weapons while protesting on decreed federal lands.
4. Reporters present to cover the protest are themselves guilty by association and are conspiratorial in their nature.
5. Law enforcement personal are wholly justified in shooting to death an individual running away from a crashed vehicle (at a hidden roadblock--which was staged in gross disregard and violation of that agency's departmental policy), who may or may not have been reaching for a firearm.

The Bundy brothers remained in jail Friday following a dramatic acquittal a day earlier in a courtroom that erupted into chaos after an attorney yelled at a judge for their release, resulting in him being subdued with a stun gun and arrested.

A jury delivered an extraordinary blow to the government Thursday in a long-running battle over the use of public lands when it acquitted all seven defendants involved in the armed occupation of a national wildlife refuge in rural southeastern Oregon.

After the verdicts were read, an attorney for group leader Ammon Bundy demanded his client be immediately released and repeatedly yelled at the judge. U.S. marshals tackled attorney Marcus Mumford to the ground, used a stun gun on him several times and arrested him.

U.S. District Judge Anna Brown said she could not release Bundy because he still faces charges in Nevada stemming from an armed standoff at his father Cliven Bundy's ranch two years ago.

The 51-page Nevada indictment lays out these charges and potential penalties:

Conspiracy to Impede and Injure a Federal Law Enforcement Officer – 6 years, $250,000 fine
Assault on a Federal Law Enforcement Officer – 20 years, $250,000 fine
Threatening a Federal Law Enforcement Officer – 10 years, $250,000 fine
Use and Carry of a Firearm in Relation to a Crime of Violence – 5 years minimum and consecutive
Obstruction of the Due Administration of Justice - 10 years, $250,000 fine
Interference with Interstate Commerce by Extortion - 20 years, $250,000 fine
Interstate Travel in Aid of Extortion – 20 years, $250,000 fine

The indictment also includes five counts of criminal forfeiture against each defendant. That means if Bundy and his sons are convicted, they will face forfeiture of property obtained from the proceeds of their crimes, totaling at least $3 million, including Bundy's cattle that roam free year-around at the Bunkerville Allotment and Lake Mead National Recreational Area in Nevada

Marcus R. Mumford, the Utah attorney who successfully represented Ammon Bundy in federal court in Portland, was found dead in his home Monday morning.
A colleague and friend who had stopped by Mumford’s home in Salt Lake City to bring him breakfast and discuss a case found Mumford, said Mumford’s sister-in-law, Katie Mumford.

Mumford, 46, lived alone. Family members don’t know what caused his death.



Angie Bundy, wife of Ammon Bundy’s brother and co-defendant Ryan Bundy, wrote on Mumford’s Facebook page Monday:

"Marcus Mumford was fearless in defending Ammon and the other men in the trial in Portland. He also became a friend to the family and he will be greatly missed. He was the one who felt that the case could be won, and helped make it happen. Our hearts are broken, Rest in Peace.''

Isn't Bundy organizing against the shutdown? This is the lawyer the feds tazed and disbarred after the win. The feds hate both of them. Possibly suicided or silenced? The timing is mighty suspicious like usual.
