RICHMOND — The FBI and local police are investigating how at least 19 dead Virginians were recently re-registered to vote in this critical swing state.

One case came to light after relatives of a deceased man received a note congratulating him for registering, Rockingham County Commonwealth’s Attorney Marsha Garst said Thursday.

“His family members were very distraught,” said Garst, who confirmed the existence of the FBI and police investigation but said she could provide few details because the case is ongoing.

All 19 were initially registered as voters in the Shenandoah Valley city of Harrisonburg, although a clerk double-checking the entries later raised questions about one. She recognized the name of Richard Allen Claybrook Sr., who died in 2014 at age 87, because his son is a well-known local judge. She happened to recall that the judge’s father had died.

Several weeks after a court ordered Ohio to stop cleaning its voter rolls from dead voters, likely raising the specter of voter fraud in the key battleground state, a new report reveals how Virginia and Pennsylvania — two other critical states — have seen hundreds of cases of non-citizens voting. That raises the question: Is the foundation of our democratic republic and national sovereignty no longer secure?

Earlier this week, the Public Interest Legal Foundation (PILF), headed by former Justice Department Attorney J. Christian Adams, released a pair of damning reports showing how the voting rolls in parts of Virginia and Pennsylvania are compromised with ineligible voters and that some of those voters have actually cast ballots in recent elections. What is more disquieting about this analysis is that it covered only a handful of counties via public record requests made through the National Voter Registration Act. Thanks to stonewalling from local election officials, a story Conservative Review first broke, PILF could not obtain comprehensive data on these two battleground states, which makes it all the more likely the number of registered voters who are non-citizens or otherwise ineligible to vote is much higher.

The Virginia report, which was the first to be released this week, found 1,046 non-citizens registered to vote in eight counties, who “cast a total of 186 votes between 2005 and 2015.” But here’s the kicker: This was a mere sample from 133 election jurisdictions in the state. And as PILF’s Adams noted in an article at PJ Media, this report does not cover “the behemoths of Arlington and Fairfax Counties.”

Moreover, Adams made it clear that this sample only covered self-reported aliens.

Now imagine the total number of non-citizens registered in theses eight counties. Then, add another 125 localities, including the largest population centers in Northern Virginia with huge numbers of non-citizens. Consider the following reality: Virginia is home to a large and fast-growing immigrant population. According to Pew, there were over 1 million immigrants in Virginia as of 2014. In 2013, according to the Census, the number of non-citizens in the state was 427,535, but given the fast pace of new immigration to the region, that number has likely grown. If a random sampling from just eight counties showed over 1,000 non-citizens registered to vote, one can easily speculate that thousands more are registered statewide.

What is so sad here is that preserving the franchise for citizens and eligible voters should not be a partisan issue. In a sane world, a discovery of this magnitude from such a tiny sample of registration lists should spark an immediate bipartisan push to verify every name in every country to ensure non-citizens are not voting. The absence of such an urgent response can lead to no other conclusion than a willingness on the part of Democrats to steal the sovereignty of the citizenry.

As Adams observed, most of the counties in Virginia took active steps to prevent PILF from examining the voter rolls. In a world without ubiquitous malfeasance in government, public officials would welcome every opportunity to ensure that not a single non-citizen is registered to vote, especially after so many discoveries were made.

All of the forms had been submitted by a private group that was working to register voters on the campus of James Madison University, according to the Harrisonburg registrar’s office. The group was not identified. No charges have been filed.

Sometimes if people are being paid by the voters they sign up they may have incentives to register fake names to get paid more. Or also possibly a college student faking it as a joke.


House Minority Leader David J. Toscano (D-Charlottesville) said the case was not proof of voter fraud because no one had actually managed to cast a vote in the names of the dead.

“First of all, there was no voter fraud — they caught him,” Toscano said. “Nobody cast a vote. . . . There’s still no evidence of that going on in the state. But there is evidence every time you turn around that the Republicans are trying to make it more difficult for citizens to vote in elections.”

NEW: JMU Student Tied To Voter Registration Fraud

HARRISONBURG — A James Madison University student was identified Thursday as the target of an FBI fraud investigation involving voter registration applications filed in the names of dead people.

The Daily News-Record is withholding the student’s name until more facts about him and the case are revealed, but he worked for HarrisonburgVotes, a voter registration drive organization whose co-founder disavowed the student’s alleged actions.

HarrisonburgVotes organizer Joe Fitzgerald, a prominent local Democrat, said he contacted Harrisonburg police on Aug. 16, the day after the student — who acted on his own, Fitzgerald said — confessed to him.

“Who the hell knows what his motivations were,” Fitzgerald said.

But a highly-placed source close to the case says the investigation began when the Harrisonburg Registrar’s Office alerted authorities to suspicious applications, and that nothing about the applications tied them to the student.

Another source close to the investigation said that agents assigned to the case are carefully examining all applications turned in by HarrisonburgVotes “just to be thorough.”

It remains unclear who, if anyone, will be charged. But city Director of Elections Deborah Logan said she will turn in all applications found to be false to the Harrisonburg

Electoral Board so they can be removed from the books.

The student's involvement in the case was first reported today by The Breeze, the student newspaper at JMU.

Authorities say a James Madison University student confessed that he acted on his own for nonpolitical personal reasons when he filed voter registration applications in the names of dead people, not on behalf of the voter registration organization he worked for.

But two sources close to the FBI and Harrisonburg Police Department investigation said Thursday that agents are continuing to carefully examine all applications turned in since February by the HarrisonburgVotes registration-drive organization, “just to be thorough.”

HarrisonburgVotes co-founder Joe Fitzgerald identified the student as senior political science major Andrew Spieles. One of the sources close to the investigation confirmed the identity of the suspect. Fitzgerald said he fired the student immediately after the suspect confessed on Aug. 15, and contacted authorities the following day.

“He’s smart, and he understands the [political] process,” said Fitzgerald, a prominent local Democratic politician who founded HarrisonburgVotes with lawyer Tom Domonoske, a member of the nonpartisan Harrisonburg School Board. “Who the hell knows what his motivations were?”

An attempt to reach the student through a Facebook page in the name of Andrew J. Spieles, a member of the Virginia Young Democrats, was unsuccessful, as were attempts to reach him at a phone number and email address listed on a JMU online directory in the name of Andrew James Spieles.
