Emojis can pretty much be used to express any emotion or thought these days, but now, a 12-year-old girl is actually facing criminal charges for a message she sent using emojis. According to The Washington Post , the message was posted on Instagram by a middle-schooler in Fairfax, Virginia using another student's name. It read, in part:

"meet me in the library Tuesday 🔫 🔪 💣"

The use of the gun, knife, and bomb emoji resulted in the girl being charged with threatening her school and computer harassment, and she now awaits trial in juvenile court.

The U.S. court system is currently trying to figure out how seriously to take emojis when it comes to criminal cases and this case is only the most recent in a string of cases involving emojis. Last year, a New York City teen was charged with making a terrorist threat after posting a message on Facebook that read "N***a run up on me, he gunna get blown down 👮 🔫 🔫 🔫 ". A grand jury decided not to indict the teen on the charge. The Washington Post reports his lawyer, Fred Pratt, later explained to the police that "something is definitely lost in translation" and that when kids use emojis in this manner, it's not meant to be taken seriously.

As for the 12-year-old girl in question, according to The Washington Post, her mother says her Insta comment was posted as a response to being bullied at school and wasn't meant to be taken seriously. Even though a spokesman for Fairfax County schools said the threat was deemed "not credible," the hearings are not open to the public, and it remains unclear whether the case has been settled or will go to court.

There is something perverse about closed, non-jury proceedings. I suspect that long ago - if not from the outset - things flipped from seeking to protect the underage accused to protecting the accusers.

Naturally, I don't believe statements of not just fact but common sense ought to be considered actionable threats.

This thread makes me feel old. I can still remember when this kind of stuff was handled by the school and the parents.

Years ago my son was around 5th-6th grade and was working on a power point presentation at school.

My kid was overly gentle, in fact he was terrified of cactus among other fears like escalators and spiders. We were a little concerned coz kids could walk over him. Once in a while his books would go missing and he would get a ZERO on an assignment and after some serious drilling we'd finally find out another kid borrowed his book and would never give it back (Happened a few times). He got picked on a bit. I signed him up for kickboxing private lessons to help him with self defense. He cried and refused because he said he couldn't hit the instructor he didn't want to hurt anyone. The instructor used to ask him to throw a punch my kid would barely softly wave his hand.

One day he was flipping through pics for this power point project. One of the pics landed on a picture of a gun as the teacher walked by his desk. So there is a picture of a gun from the stock power point photos on my son's computer screen when the teacher walks by.

Teacher went ape shit. My son had no clue what was happening. Suddenly he's being escorted out of class and into the principal's office. He's getting stern warnings and all kinds of threats about his behavior and threats of being kicked out of school. I'm summoned to the school.

All the while I'm thinking about the teacher....Dude you fuck nut have been with my kid for half a year or so, and haven't noticed this kid is terrified to hurt a fly? He's terrified of authority, he's terrified of everything, fuck he said he refuses to go to any state or foreign country that might have CACTUS! Who's afraid of fucking CACTUS!?!? He's one of those sweet gentle kids. In fact that's what every teacher had been calling him since he was born. Anyone who knows my kid knows he can't throw a punch let alone shoot a gun. He's terrified of violence!

Anyway I feigned deep concern and promised the school it won't happen again and there's no domestic issues, nor any emotional issues blah blah blah. I can't even remember all the checks and procedures we had to go through to make sure everything was OK.

When we go home I just asked what was that about. He literally said I was flipping through pics in power point when that popped up. I just told him to be more careful when flipping through pics.

Thankfully that's all that came out of it, but reading this story I'm realizing my kid could have been in deeper trouble in today's climate. Maybe he could have been one of these kids being possibly charged with something.

Also thankfully he hit puberty and some testosterone kicked in and that terrified of everything turned out to be a phase, he's still the sweet gentle kid, but seems to be able to defend himself now. He will now forever deny he was ever afraid of cactus or escalators, but spiders still scare that crap out of him....Can't totally blame him, spiders are fucking scary.

Sue the emoji makers for contributing to the delinquency of minors. Seriously, if this is such a big deal, why don't these social media sites prohibit the use of these icons in their posts, they prohibit the use of curse words, so why not this as well?

And these DA must be getting desperate for criminal cases, cause this claim hunts no dogs.
