The bill is worded in an extremely strange way. It's specifically only students, and only public school bathrooms. A transgendered parent, teacher, or other non-student could utilize whatever bathroom they please. Also, this was probably a bad idea:


The term, biological sex, as used in this Act, means the physical condition of being male or female as determined by a person’s chromosomes and anatomy as identified at birth.

They're just going to get sued using an intersexed student as plaintiff and it'll go down in flames.

Hermaphrodite? I'm not sure anymore either. This world is FUBAR. No one law is going to fix it, but I agree that for at least kids under 18 (maybe 16? 13?), their bath facilities should be separated by their plumbing.

Better still, abolish state schools and let the parents, communities and private schools decide.

There are some forms of ignorance and laziness that are impossibly irritating. The use of "gender" in lieu of "sex" invites my hand to cause the taste of those uttering it to flee from their mouths upon wingèd slap, to return no more. Such personal transgressions deserve nothing less than this, for such willful laziness and doltery ought not be tolerated from people who should know better. Therefore, let them be trained the hard way if found to have apparently been sleeping during their lessons in grammar. And yes, this goes for me as well.

IIRC, SD passed a law last year when Omdahl discovered an ingrown hair on his ballsack. Passed unanimously.

Oh, and I find it endlessly disturbing to discover that the grammar checker on this machine doesn't flag "ballsack" as a non-word.

I'm an agoraphobic and it's oppression to expect me to have to use a public restroom where so many other people may be waiting in line outside the door or at the sink washing their hands.

I demand a law that states everyone else must leave the restroom whenever I have to pee. Accommodate me or I'll sue.

It's a birth defect. An intersexed person is born with ambiguous genitals, such the doctor may not sure what sex they are. Could be both, could be none, could be whatever. It's more common than you'd think.

It's not 'what is on your birth certificate' or 'what is on your ID,' I presume because they're worried about other states which may be willing to change gender information on either of those. But saying something like 'gender based on chromosomes' or 'gender based on doctor at time of birth' ignores the fact that there's a portion of the population to which that does not apply. As I said in my original post, that is how they will get sued, and they will lose.

Then again, they probably do not care if it stands up in court... I'm guessing that this is not an actual problem in South Dakota, and is instead a way to earn political brownie points without offending (m)any constituents.

It would seem to me that asking the 156 individuals with half a penis to use the men's room would be a better solution than encouraging all the men with a whole penis to arbitrarily choose.

if its worded that way, it actually gives those 156 individuals free choice; genotype or phenotype at birth. I see no issue with that for those rare cases: Allow people with genuine congenital intersex to use free choice of public facilities, while preventing genetic and pronounced voyeur males with mental illness out of the ladies room regardless of their immediate state of self mutilation. I think most of us are opposed to the presence individuals born both genetically and phonetically male in the ladies room.

I would think that people with anomalies don't generally go around advertising it. They just use the restroom and leave. It's not a big production. Sexual abiguity is different than sexual fluidity. One is medically diagnosed. The other is a perversion.

I think we're all missing the fundamental issue which needs to be readdressed here: should we continue having government-run, publicly-funded schools? Because our public schools are controlled by public policy, the issue of transgenderism continues to be a politically-correct one, in which politicians must argue different aspects of transgenderism within the context of public opinion and not necessarily the objective ethical ramifications of transgenderism.

If our schools were private, then the issue of whether or not transgenders can use opposing restrooms would take care of itself. It would be up to private investors and parents of those schools, naturally.

I just don't see how it is harmful in anyway for a MtF trans to be in a girl's restroom or a FtM in a man's restroom.
