Arizona state Sen. John Kavanagh (R) has just proposed a bill that will criminalize recording (http://countercurrentnews.com/2016/01/arizona-to-ban-recording-cops-without-their-permission/#) police or police activities without the permission of the officers in question.
If photographers are within 20 feet of an officer, they must have that officer’s express permission, according The Arizona Capitol Times (http://azcapitoltimes.com/).



Senator Kavanagh claims that Senate Bill 1054 still allows citizens to film at 21 feet. But he offered no explanation for how officers would determine such precise differences except by their own estimation (http://countercurrentnews.com/2016/01/arizona-to-ban-recording-cops-without-their-permission/#) and guesswork.
Still, he maintains that 21 feet is “close enough because cameras have improved so much.”
“Most cameras have great resolution where you don’t really lose anything when you’re 20 feet away,” he claimed.
So, as long as you have the money to have a good camera (http://countercurrentnews.com/2016/01/arizona-to-ban-recording-cops-without-their-permission/#), “at 20 feet you can pretty much pick up small objects (http://countercurrentnews.com/2016/01/arizona-to-ban-recording-cops-without-their-permission/#).”
If Kavanagh’s bill passes, a first offense for filming the police will result in a $300 fine. Future violations will actually see photographers locked up in jail for up to six months – all for recording the police.


Kavanagh himself happens to be a retired cop. Currently he teaches criminal justice (http://countercurrentnews.com/2016/01/arizona-to-ban-recording-cops-without-their-permission/#) courses at a community college (http://countercurrentnews.com/2016/01/arizona-to-ban-recording-cops-without-their-permission/#).
He says his proposal should become law because it is a “distraction” to have someone filming while you are making an arrest.
“Having one or more persons suddenly walking up behind and around them with cameras is a distraction,” Kavanagh said. “The officer doesn’t know if this is somebody who’s a friend of the individual he’s doing law enforcement action against or what.”


But the reality is that many people are filming to prevent the police from engaging in acts of brutality – or to document it when they are.

And you know the real issues with these laws are that the police are going to establish a perimeter, there will be a police officer that commands you back 20-40 feet away from the area of interest and then further command you away from them and additional 20-feet otherwise face being arrested for violating the law. So there you are 50 or more feet back with one or more officers standing in front of your blocking a large portion of your view, and being threatened with arrest for doing nothing wrong whatsoever.

While i agree he is a scumbag and should be kicked the hell out of office, didn't the SC already say that it is completely lawful to film public employees conducting public business. I'm not in his district but seeing that i am in AZ i'll put in a call on Monday...

Even less surprisingly, Kavanaugh is an ex-cop. An ex New Jersey cop.

New Jersey is a notably corrupt state, run by thugs like Chris Christie – who is known to have used his powers to abuse his political opponents (see here) and steer lucrative state contracts to family and friends like a real-life Tony Soprano (see here).

Police performing their duty in a public place have ZERO reasonable expectation of privacy. If the public has a right to be there, they have a right to see what is happening, and by extension, the right to record. A camera is NO different than the human being holding it. If you criminalize filming police, you have simultaneously criminalized WATCHING police in public.

This does not come even remotely close to passing constitutional muster.

Been so long I forget where it was located... North of Main Street, methinks. I used to eat there every morning and often for lunch. Red place with drive through. Looked like a shit hole, but the food was really good, and very inexpensive.

Sometimes I miss the desert.

May come visit in Feb. Daughter is having an art gallery exhibit. I should try to be there.
