• More than 200 people were treated at hospitals for injuries associated with Tuesday's night Amtrak train crash, Philadelphia emergency management director Sam Phillips said.
• Seven members of the National Transportation Safety Board are at the derailment site in Philadelphia as of 10 a.m. Wednesday, and more are coming, Philadelphia Mayor Michael Nutter said. Investigators will look at a number of factors, including the track, the train signals, the operation of the train, the mechanical condition of the train and human performance, NTSB board member Robert Sumwalt said.
• A recorder on the train, known as the "black box," has been recovered and is being examined, the mayor said

Derail Accessories
Derails are emergency car stopping devices to prevent unauthorized movement of a locomotive or railcar. the derail lifts the flange of the car wheel and drops it clear of the rail. Simultaneously, the wheel opposite the derail is guided off the rail. Once the car wheel leaves the rail, forward movement is greatly impeded.

While rescuers were still searching for survivors after an Amtrak train crashed in Philadelphia, Fox & Friends interrupted their breaking news to ask two lawyers about the financial benefits of suing the government.
The New York-bound trained derailed at around 9 p.m. on Tuesday, killing at least six people. By early Wednesday morning, crews were still searching through the wreckage, and Philadelphia Mayor Michael Nutter (D) said that officials had not yet been able to account (http://www.nytimes.com/2015/05/14/us/amtrak-train-derails-crash-philadelphia.html?_r=0) for all of the passengers.ADVERTISEMENTHowever, Fox News host Elisabeth Hasselbeck took time out of coverage of the emergency to wonder about the “legal implications.”

“Amtrak is owned by the government,” she pointed out. “How does that complicate things in terms of what the passengers’ rights to claims are?”
Defense attorney Whitney Boan suggested that passengers and families of the deceased could seek damages from the government, train parts manufacturers, and Amtrak employees.
“The legal implications will become more clear as we find out more about what happened,” she observed.
“What specific claims could passengers be putting forward here?” Hasselbeck asked. “In particularly, the families of the deceased.”
Attorney Eric Guster suggested that families should consider suing for wrongful death and possibly for faulty equipment.
“There is liability somewhere because trains are not supposed to derail,” he added. “But the question is who. Who is to blame?”
Hasselbeck concluded by asking if trains should have seatbelts.

Lives lost in Amtrak train derailment: midshipman, tech CEO, AP video staffer, bank VP

At least seven people were killed in Tuesday’s Amtrak train derailment, including Justin Zemser, a 20-year-old midshipman at the U.S. Naval Academy; Rachel Jacobs, 39, chief executive officer of Philadelphia-based ApprenNet; Jim Gaines, a 48-year-old video software architect for the Associated Press; and Abid Gilani, 55, a Wells Fargo executive.
Among those missing is Bob Gildersleeve, a vice president the St. Paul, Minnesota, based company Ecolab. The names of the others killed in the violent crash — which demolished one train car and toppled others on their sides — remain unknown, but the lives of those confirmed to have died illustrated the depth of Tuesday’s catastrophe.

I dunno what to call it. Probably involuntary manslaughter? I am not in any way educated on law so I can't really comment beyond the same type of speculation anyone else would do. Most likely operator error.

It would also rule out foul play angle that was raised by Drudge headlines today and checked during rail derail in Canada while back.

To insure the derailment of a modern locomotive it is necessary to remove a length of rail equal to the length of the fixed wheel base of the locomotive. For practical purposes, removal of 20 feet of rail on one side of the track will result in the derailment of any locomotive.

The most effective place to make the cut is on the outside rail on a curve. Where two or more tracks parallel, derailment should be made in such a manner that a train wrecked on the inside track when rounding a curve will tear up and obstruct all the tracks.

FBI investigates report that projectile hit windshield of Amtrak train moments before it crashed... as it's revealed TWO other trains were also struck minutes apart on the same corridor



Conductor on derailed train said she overheard Amtrak Train 188 engineer Brandon Bostian report on the radio that his train was hit in the windshield

Moments later, at 9.21pm on Tuesday, the train derailed killing eight
At 9.05pm Tuesday, a different Amtrack train reported being struck in a window by an unknown object
At 9.10pm Tuesday, a northbound SEPTA regional rail train reported it had been 'hit by a rock or shot at' in the windshield
All three incidents happened within a few miles of 30th Street Station along the same stretch of track outside Philadelphia





An assistant conductor on Amtrak Train 188 has told National Transportation Safety Board investigators she heard Amtrak engineer Brandon Bostain say that his train had been hit by something. Seconds later, the train careened off the tracks.

Amtrak Employee Injured in Derailment Files Lawsuit

Phillips, an Amtrak employee, was "deadheading" in one of the rear railcars of Amtrak Regional Train 188 Tuesday night when the derailment occurred, according to the lawsuit. Deadheading is a practice in which a crew member is transported free of charge when they're not working.

During the derailment, Phillips was "violently hurled" inside the railcar and his body was struck several times before he slammed onto the floor, according to the lawsuit. PHILADELPHIA (CBS) — In the wake of the derailment of that Amtrak train in Philadelphia more than two weeks ago, killing eight people and injuring more than 200 others, the rail operator is beginning installation of cameras in locomotives. “These systems will be another tool for Amtrak and industry regulators to monitor locomotive and engineer performance,” the press release reads, in part.
“Inward-facing video cameras will help improve safety and serve as a valuable investigative tool,” Amtrak President and CEO Joseph Boardman comments in the press release.

Thousands evacuated after freight train derails, catches fire, in Tennessee

A freight train carrying flammable and toxic gas derailed in eastern Tennessee, igniting a fire in one car and spreading noxious fumes that forced the evacuation of more than 5,000 people and the hospitalization of 25, officials said.

Homes and businesses were evacuated following the derailment around midnight Wednesday of the CSX Corp (CSX.N) train in Blount County, near Maryville, the officials they said.
CSX and U.S. regulators are investigating the derailment's cause. Local officials said the U.S. Environmental Protection Agency was monitoring air quality in the area.
Twenty-five people were admitted to Blount Memorial Hospital with respiratory issues as of 5:30 p.m. EDT, while another 27 were held for observation in the emergency room at various times, hospital spokesman Josh West said.

"We didn't think we'd be there that long, but now it's starting to look like we may be there for a couple days," he said from the animal center. "We've had trains derail before, but not with chemicals, so it's pretty bad."

Firefighters were allowing the blaze to burn itself out on the advice of specialists, as attempts to extinguish it could be hazardous, Blount County firefighter Kermit Easterling said. CSX said at 3:30 p.m. that the tank car continued to burn, making it unsafe to establish any transfer operations.
