Caution Graphic Language: White House Responds to Racist OU Frat Video, Repudiates It

"Growing" OU racist rant scandal has evoked a White House response now. SAE frat chant video clip had made natianal headlines yesterday, a day after Obama-Bush unity front marched in Selma to mark 50th anniversary of bloody Sunday.

[ This seems odd, and even bit fishy, if a few teens/young adults youtube racist chant video can be top national news headline on Google all day yesterday/today and then Office of the President makes time to repudiate it with all else that is going on in the world. Too early to say for sure but it looks as if "race card" play is a welcome play for Obama handlers lately, such suggestions were made when Obama invoked his son in Treyvon Martin while staying tight-lipped after Miriam Carey's execution by DC cops.

When I first saw the racist video of Sigma Alpha Epsilon fraternity brothers (http://bluenationreview.com/leaked-video-show-oklahoma-frat-chanting-lynching-ns/) chanting about “lynching ******s,” I never imagined that the White House would respond. But it appears the incident at my alma mater has gathered enough steam on social media to warrant a response from the White House Press Secretary.

As anti-racism protests continue to take place on the University of Oklahoma campus following a viral video clip displaying Sigma Alpha Epsilon (http://www.huffingtonpost.com/2015/03/08/frat-racist-sae-oklahoma_n_6828212.html?utm_hp_ref=college) chanting racist lyrics about their chapter, it appears the college is also beginning to experience backlash from entertainers.
According to an Instagram post, Waka Flocka Flame has cancelled his upcoming April concert at the University due to SAE’s offensive behavior.
“I know for a fact the whole school and SAE don't agree with those kids actions so know that I'm not mad at the whole #SAE just those disgusting kids,” the rapper wrote on Monday to his 1.1 million followers. “We can't change history but we damn sure can create our own future #DeathToRacism.”

University of Oklahoma Expels Students for Constitutionally Protected Speech

University of Oklahoma (OU) President David Boren has decided to expel two students, who were members of the university’s now-shuttered chapter of the Sigma Alpha Epsilon (SAE) fraternity, for their alleged “leadership role in leading a racist and exclusionary chant,” as shown in a video posted online recently. As FIRE wrote on The Torch yesterday, absent additional elements like true threats, the expression shown in the video is protected under the First Amendment, and punishing students for their participation in the chant is almost certainly unconstitutional.

Constitutional law professor Eugene Volokh reminds Washington Post readers of this important point in a column published today:


[R]acist speech is constitutionally protected, just as is expression of other contemptible ideas; and universities may not discipline students based on their speech. That has been the unanimous view of courts that have considered campus speech codes and other campus speech restrictions — see here for some citations. The same, of course, is true for fraternity speech, racist or otherwise; see Iota Xi Chapter of Sigma Chi Fraternity v. George Mason University (4th Cir. 1993).

Volokh also clarifies that “speech doesn’t lose its constitutional protection just because it refers to violence.” Speech will lose protection if it falls into one of the few and narrowly defined categories of unprotected speech, like true threats or incitement to imminent lawless action. But the chant in the video does not fall into any of these unprotected categories.

As FIRE explains in our freshly updated Guide to Due Process and Campus Justice, students at public universities who are facing expulsion have a right to notice of the charges against them and an opportunity to contest those charges. Boren, however, apparently made his decision to expel the students before affording the students a hearing, spurred by the media storm that followed the SAE video.

FIRE President Greg Lukianoff noted in his book Unlearning Liberty: Campus Censorship and the End of American Debate: “Fraternities consistently produce some of the least sympathetic cases for campus free speech advocates. Incidents like dressing in blackface and Klan robes for a Halloween party, as Tau Kappa Epsilon at the University of Louisville did in 2001, do little to endear fraternities to the public.” So it’s unsurprising that the fraternity has been harshly criticized—and everyone has the right to voice their opinions about SAE, the chant, and the individuals involved in making the video. However, the law is clear: the University of Oklahoma’s expulsion of two students, without due process, simply for their expression of racist sentiment is almost certainly unlawful and should be reversed.

Yeah, but that could've reflected on Washington DC, and might've blown back onto him. He can't have that. From Henry Louis Gates to Trayvon to Mike Brown to Eric Garner, Obama likes to stick his beak in to these local and show everyone that he's "down with the struggle". His wife does it too, with her talking about how they were "treated like the help" (which I don't buy for one single solitary moment). Obama goes out of his way to claim that he's in touch with the "plight" of urban blacks, and his favorite is white on black crime. I've never heard a peep out of him when it comes to black on black or - God forbid - black on white crime, which happens exponentially more.

He's one of the slimiest, slipperiest Presidents we've ever had. He's a poverty pimp POTUS; when he leaves politics, he'll become the Al Sharpton of his generation, but even worse because the plebes will think he's more "credible" than the race hustlers of old. Obama out of office will be almost as annoying as Obama in the White House, just you wait.

The thing needing Public Condemnation in this Incident is the high handed action of OU to expel students for exercising their Constitutional right to free speech. Doesn't really matter that some are 'offended' by the use of a word thy themselves use all the time.
