A reserve deputy constable with Harris County Precinct 6 has been charged with shooting a driver in a road rage incident earlier this month on the 610 South Loop, Houston police said.

Kenneth Caplan, 34, was arrested on Wednesday. He is charged with aggravated assault with a deadly weapon, accused of shooting a woman and grazing her head.

She was driving on the South Loop between Buffalo Speedway and Kirby on Nov. 11 when she was shot, according to Houston Police Department spokesman Kese Smith. She had non-life-threatening injuries, Smith said.

Caplan had fled the scene, but authorities found him at his home Wednesday and he confessed to shooting at the other driver, according to Smith.

Caplan was not on duty at the time of the incident and wasn't wearing his uniform, according to a news release from the Precinct 6 constable's office.

"Precinct 6 neither condones nor tolerates the actions taken by Kenneth Caplan that connected him to this incident, and the necessary measures were taken to collect his credentials and remove him from our status," the release states.

Caplan is in jail with a $200,000 bond, according to the Harris County District Clerk.

Probably a stupid question but does it matter that he was off duty ?

They'd charge the woman instead on a trumped up charge?

aggravated assault with a deadly weapon

There is usually another charge added on top of this if it were to happen to a cop....

"aggravated assault with a deadly weapon and aggravated assault with a deadly weapon on an law enforcement officer."

It's a two fer. You sure won't see one for "aggravated assault with a deadly weapon on a citizen."

The victim told KHOU,

"All of a sudden I'm driving, and this guy cuts me off.
He was about to hit me.
I switched to the other lane,
I got in front of him and I cut him off.
I guess that pissed him off.
He went like that and he just fired at me.

And then all of sudden I heard a ring in my ear."

Houston police told the Houston Chronicle (http://www.chron.com/news/houston-texas/houston/article/Reserve-deputy-constable-charged-in-road-rage-5921850.php) that Caplan fled the scene but later confessed to the shooting.
