Two California poker players are refusing to fold in a legal battle against the state, claiming Iowa State Patrol troopers unlawfully seized their $100,020 gambling bankroll.

Another case of highway robbery. It used to be the police tried to catch the robbers, now the police are the robbers.

What Furillo experienced in May happens to thousands of drivers in Iowa, according to data obtained under open-records laws by The Des Moines Register Reader’s Watchdog.

An Iowa district court judge threw out one Poweshiek County felony drug case this year against an Iowa college student after ruling a State Patrol interdiction team member conducted an illegal search.

Des Moines attorney Robert Rehkemper challenged the search in February of Ashford University student Kyle R. DeFauw’s car.
DeFauw, then 21, said he and passenger Daniel Balgooyen were returning to Clinton from a snowboarding and skiing holiday in Colorado when they were followed by trooper Justin Simmons on Interstate Highway 80.
Simmons turned on his in-car video and audio as he followed the vehicle, which had Illinois license plates, according to court documents. Simmons commented several times while being recorded that the car was dirty and that part of DeFauw’s plate was covered by dirt.

Since poker's a cash business it's normal for players to have to carry large amounts of money. There's been a bunch of stories of players having money seized either thru traffic stops or at airports on their way to tournaments. Pretty sure I've seen more people ask about how to be safe from police/TSA than from a random mugger.


More than 10 minutes after he began following the car, Simmons initiated a traffic stop, claiming Newmerzhycky failed to signal while passing a black SUV.

On the video at :28 you can see that he does turn on his signal before changing lanes.


After telling Newmerzhycky he was free to leave with a warning, the trooper asked whether there were any drugs or cash in the car. Despite Newmerzhycky's asking if he was free to leave, Simmons called Trooper Eric VanderWiel to the scene so that VanderWiel's drug dog, Laika, could scan the car's exterior.

So close. Cop even said "ok, you guys have a safe trip back".
