JACKSON, Miss. —Lawyers for U.S. Senate candidate Chris McDaniel allege he defeated incumbent Thad Cochran by more than 15,000 votes in the June 24 Republican primary election.

"They asked us to put up or shut up -- here we are," McDaniel said in a news conference Monday.

McDaniel and his attorney, Mitch Tyner, said they'll file an official legal challenge to the Mississippi Republican Party Executive Committee.

"The facts are on our side. The law is on our side," McDaniel said. "We look forward to our venue in front of the Republican Executive Committee. This is the opportunity for our party to take the lead on honest, good, transparent government."

The Mississippi Republican Party nominated Cochran, the incumbent, as its candidate after certifying the results June 24 runoff election, which Cochran won by more than 7,000 votes.

Tyner said a review of the election results by McDaniel supporters found 3,500 crossover votes, 9,500 irregular votes and about 2,275 absentee ballots that were improperly cast, among other voting problems.

"We anticipate after they review the challenge, they'll see Chris McDaniel clearly won the Republican vote in the runoff," Tyner said. "Now, I say that very assuredly because that's what the mathematics show, that's not what I'm arguing."

Mark Garriga, an attorney for the Cochran campaign, said Jackson law firm Butler Snow has been hired by Citizens for Cochran to defend the election challenge........

Good! It's about time a candidate stood up to the vote rigging! I'm certain Brannon was screwed out of a run-off against Tillis because of absentee vote and computer tabulation rigging. We know Ron was dicked out of primary wins by various shenanigans. God only knows how many other elections have been stolen from candidates. THIS is probably the most important issue for activists that still participate in the electoral/political process. What difference does your effort make if the vote counts don't matter??

A press conference concluded a few minutes ago by the McDaniel campaign suggests that the campaign found far fewer illegal votes than the approximately 7,600 votes separating him from Sen. Thad Cochran in the MS Republican Senate primary. Instead, it sounds like the campaign has alleged only 3,500 votes cast by voters who also (presumably illegally) voted in the earlier Democratic primary. There are 9,500 other votes said to be “irregular,” and 2,500 allegedly improper absentee ballots.

Those numbers alone suggest there will not be enough to get a new election, unless the “irregularities” are serious enough to call the result in question. But that would not be impossible, depending on what the evidence shows.
But the reason I expect McDaniel will likely lose is that he is not asking for a new election. Instead, he is asking for a remedy of having him declared the winner. He would apparently rely upon polling to show that Democrats who voted in the primary did not intend to vote for the eventual Republican nominee in the fall. This relies upon a MS code provision saying that only those who will support the nominee in the general election can vote in the primary.

UPDATE: The McDaniel campaign has now posted its election contest papers. I have put them up on Scribd (http://www.scribd.com/doc/235855819/2014-8-4-Complaint-and-Exhibits)in a 13 mb file (instead of the original 104 mb file). The contest presents an even weaker claim than was described at the press conference. This will almost surely fail before both the MS Republican party and in court.

To begin with, despite all the talk of massive fraud by the McDaniel campaign for weeks, there is virtually noting substantiating fraud alleged in the complaint. The main “fraud” is Democrats who intended to vote for the Democratic nominee during the general election being allowed to vote in the Republican primary. Given that such voting was deemed acceptable before the election by both the Secretary of State and the Attorney General (in line with longstanding practice and an earlier AG opinion), neither the party nor the court will count this as fraud.

The GOP was always using obscure party rules to screw Paul supporters in the last 2 elections! :mad:
McDaniel's people have alluded to RNC Rule 11(b).
Hope turnabout will mean fair play this time around!


Rule 11(b) states:

"No state Republican Party rule or state law shall be observed that allows persons who have participated or are participating in the selection of any nominee of a party other than the Republican Party, including, but not limited to, through the use of a multiparty primary or similar type ballot, to participate in the selection of a nominee of the Republican Party for that general election. No person nominated in violation of this rule shall be recognized by the Republican National Committee as the nominee of the Republican Party from that state."
