FAIRFIELD —Fairfield police have released files and information about a shooting that killed a 23-year-old man over the weekend.

Police said Officer Scott Conklin was the officer who shot Caleb Surface Saturday night after witness said Surface put a hand in his pocket while officers ordered him to put his hands up.

Surface had run from a domestic violence incident involving his father, police said.

When Surface's father called 911, he told dispatchers, "He's out of control, he's nuts and I need to get him away from my house."

"He just tried to open the door, grabbed a knife or something. I almost had to shoot him," Surface's father told dispatchers.

During the 911 call, Surface's father said his son was under the influence of drugs or alcohol.

Radio traffic between officers looking for Surface included a transmission that "The subject we're looking for is also potentially suicidal. He was asking to be shot and he began to try and cut his wrists."

Minutes passed and another officer radioed in.

"I got him at gunpoint. He's claiming to have a firearm on him."

Ten seconds passed between when the officer said he had him at gunpoint and shots being fired.

Police have not said what happened during that time or if Surface was armed.

As for the officer, Conklin has half a dozen commendations, but last year was a rough one. His last review in December was unsatisfactory.

He's been suspended for poor attendance, working less than half of his scheduled days in a 90-day period. He's also been reprimanded for not following up on four cases. Conklin was even sued by a fellow officer for failing to pay him back $500 he borrowed.

Police said Conklin is an 11-year veteran of the Fairfield Police Department. Before that, he spent five years as a Cincinnati police officer.



Shooting victim’s family ‘not satisfied’ with grand jury ruling

The family of a man shot and killed by a Fairfield police officer “is not satisfied” with the results of an investigation that cleared the officer of any wrongdoing.

On Jan. 18, Caleb Surface, 23, was shot to death by Fairfield police Officer Scott Conklin in a cul-de-sac at the end of Saint Andrews Court. Conklin was responding to a domestic dispute on Spyglass Hill Court, which is just north of Saint Andrews Court.

The results of a Bureau of Criminal Investigations report were presented to a Butler County grand jury late last week and no indictment was handed down. Butler County Prosecutor Mike Gmoser said the lethal use of force by Conklin “was justified.”

But Ed Kathman, the cousin of Jeff Surface, Caleb Surface’s father, said the family is unhappy with the results.

“When you look through that report, there’s nothing independent that corroborates that dialogue that Conklin said he had with Caleb,” said Kathman, who spoke on behalf of the family. “They expect us to take the word from a guy who has a checkered record. That’s the difficulty with this.”

At the time of the shooting, Conklin, a 10-year veteran, had been recommend for termination by Fairfield police Chief Mike Dickey due to work performance issues, such as questions of accuracy in his reports, showing up for work and response times. Since then, an agreement has been reached and Conklin will be given a four-day suspension.

Testimony from nine witnesses was considered by the grand jury.

At the time of the shooting, Surface was unarmed, but according to witnesses, he allegedly told Conklin he was armed and threatened to kill him. At the time of his death, a black and silver cordless telephone receiver was found in Surface’s right hand, according to the investigation.

Kathman said he would like to see more happen, and hopes there is an additional or “more of a complete report” from BCI.

He said the family would also like to see the Fairfield Police Department’s procedure on handling a “mentally unstable person.” Surface’s family had previously described him as a “kind-hearted young man who had many challenges with chemical dependency” and his father “has dedicated his life to helping Caleb overcome these issues.”

I have to wonder what they expected when they called the police. I don't suppose they expected the police to end the conflict without the use of violence.

We sometimes jokingly say that someone asked for it (getting killed by police,) but it seems that is how the police interpret it when you ask them to come over.

Yeah, it's almost as if they are upset because they had to stop eating doughnuts long enough to be bothered by somebody wanting them to help out, so they make sure to punish folks who call them.

"Suicide by cop" is a fairly common and widespread phenomenon.
