On three different dates, sentenced criminal James Olivos has failed to surrender and report to prison, claiming that he won’t get the right treatment for his morbid obesity. As reported by WESH 2 News, Olivos pleaded guilty to running a multimillion-dollar Seminole County, Florida mortgage fraud scheme and was sentenced in December to serve five years and repay $2.8 million.

The swindler used various medical excuses as the reason that he did not go to prison. In addition to his obesity, Olivos said he suffered from rectal bleeding, pain in his feet, coughing up blood, and ADHD. But, Magistrate Karla Spaulding was not buying Olivos’ “stall” tacticts and said, “I don’t see anything that confirms these complaints.” Because the magistrate was not the one to originally sentence Olivos, she did not have him arrested then and there. Instead she gave him 48 hours to hand over his medical records.

In any case he will get those symptoms while he is in jail.
