Ex Post Facto, or more specifically, when that is thrown out the window too.

"Did you do this before we made it illegal? Yep, youre a Criminal!"

It seems to me that in regards to Confidentiality is it is the only physical way to protect ones self from the Law when the Law does not abide by its own rules.
