SAINT CLAIR SHORES, Mich. (WXYZ) - "Friendly, loveable, playful,” said Brittany Preston as she described her dog Lexie. “She was just my puppy."

Preston says she left her dog with her Grandpa at his home in Saint Clair Shores, went to work overnight, came home, and the dog was dead.

She says Grandpa has mild dementia and forgot he let the dog out. The dog started barking. Between the hours of 3:00 and 7:00 a.m. several neighbors sick of the noise called police.

Preston says police surrounded the dog as her grandpa tried to let the dog in the door.

Lexie barked at police instead of going in the house. The police report says the dog charged police and they shot her.

Preston says witnesses told her that as the dog cowered against the house – they kept shooting.

“Eight shots in my dog is just horrendous,” said Preston.

Witnesses tell 7 Action news Brittany’s grandpa said the dog wasn’t his and police assumed that meant the dog didn’t belong there.

The Saint Clair Shores Police Chief didn’t want to go on camera, but said police worked for hours to catch the dog with a dog stick. He says they only shot when they felt the dog posed a danger to them – and kids out on their way to school. He says neighbors reported the dog running at people in the neighborhood earlier in the morning.

Preston just wants police to find a non-lethal way to handle dogs.

“You could sedate them and find out who their owners are, instead of killing them and worrying about it later,” said Preston.

With all the new weapons and new training to protect police and all the sophisticated equipment and all the tactics taught to our fine men in blue, one would think that this problem of non aggressive dogs turned aggressive would be dealt with by a specialist. If they suspect drugs they call in the drug team. Suspect bombs the bomb squad. It would appear an aggressive dog squad should be called in to mitigate the circumstance. If a search warrant was to be served for a known killer and the swat team suspected booby trapped bombs would they just ram the door down in a normal no knock raid fashion? When I was a little kid in the 60's in Connecticut, I walked the streets and rode my bike. Even when I was very small like 5years old. I had paper routes one in am another in pm for many years. People did not have fences and often I would walk down the street and see a very big dog that scared me. I still needed to do my job and get home. I would cross the street and leave the dog alone and continue on my way. Post office delivery and UPS & Fedex are always going onto peoples property. How come their encounters with these charging out of control dogs are not front and center on the news? I see these postal workers cutting across front lawns all the time. I had a very large doberman that would be tied to the front porch a few years back and I got my mail everyday on the porch in the mailbox. The guy liked my dog, the dog liked him. He was reassigned to another route and I even got my mail from the new guy every day. I am confident that these postal workers come in contact with dogs all the time while walking their route. How come this charging at me dog problem is not front and center in the media?

A St. Clair Shores woman whose dog was shot multiple times by city police last year has filed a federal lawsuit alleging two police officers responding to a barking dog complaint set out from the start to kill the mixed breed even though it was posing no danger.

Brittany Preston charges in the lawsuit that her dog, Lexie, was shot four times by police and then dragged away wounded to an animal control truck. Instead of being taken to a veterinarian for treatment, the dog was shot four more times, the lawsuit alleges.

Preston filed the lawsuit this week in U.S. District Court against the City of St. Clair Shores, police Officers David Jacquemain and Jeremy Moskwa, and animal control officer Tom Massey.

Interim City Manager Michael Smith did not return calls Friday seeking comment. City Council is to address the lawsuit during its meeting Monday, when Smith recommends denying the claim and referring it to the city attorney for a response, according to council’s online agenda packet.

Preston is claiming constitutional rights violations in the Nov. 22 death of her 44-pound, 18-month-old, female dog, which was shot outside her home on Princeton. Preston lived in the home with her grandfather, Thomas Warunek.

The lawsuit alleges that immediately upon arriving on the scene, one of the two officers was recorded on a dash cam as saying he was going to shoot the dog. The lawsuit claims the officers shot the dog three times as it stood on the side porch and then, after it ran into the bushes, yelping in pain, shot it a fourth time.

Officers used a neck noose on a pole to drag the wounded dog to an animal control truck, where the lawsuit says it was left for at least 90 minutes. A police report said the dog died as it was being transported to get medical help, according to the lawsuit.

But Christopher Olson, Preston’s attorney, said a later necropsy conducted by a veterinarian hired by Preston showed the dog at some point had been shot four more times.

“What really is shocking to me and upsetting to Brittany is after it was taken … it has 15 (entry and exit wounds).”

Warunek accidentally left the dog outside the home in the early morning hours of Nov. 22. About 7:15 a.m., a neighbor reported a loose pitbull at Princeton and Walton that had been barking for 90 minutes and was on someone’s porch.

Officers arrived and while the dog was barking from Preston’s front porch, an officer was recorded on police dash cam stating “The only thing I’m gonna do is shoot it. I do not like dogs.” Subsequent dash cam audio recording revealed an officer stating “I don’t do snares, I don’t do dogs … I’ll shoot the (expletive) thing.”

Police claimed the dog was shot because it attacked them, but the lawsuit alleges the dog was merely barking, not targeting the officers.

At a Jan. 6 City Council meeting, police presented preliminary findings from an internal affairs investigation that concluded no wrongdoing based, in part, because no witnesses contradicted the officers’ accounts, according to the lawsuit.

Aside from monetary damages, Olson said he wants to “make sure this doesn’t happen again.” He said because of the incident, which has gone viral and has a Facebook page “Justice for Lexie,” he is receiving many calls from people across the country relaying experiences of officers shooting dogs.

Because bullets flying about children is so much safer than somebody's pet.

Ah, the good old "for the children" catch-all that can be used to excuse anything and everything. A couple of years back a Las Vegas cop used that as an excuse to literally run down some woman's dog that had gotten out.

It turned out that the kids he was "saving" had been taunting the thing, and none were bitten -- but of course they "could" have been, so better safe than sorry ...
