Drivers could possibly be pulled over for snacking, smoking or putting on make-up behind the wheel under a bill that has been advanced in the New Jersey Assembly.

The proposed law would fine drivers found to “engage in any activity unrelated to the operation of a motor vehicle in a manner that interferes with the safe operation of the vehicle.”

The bill advanced by a 12-0 vote Monday in the Assembly's transportation committee. It does not spell out which activities would and would not be considered distracted driving, instead leaving that determination up to police.

Don't most states already have a distracted driver law that is somewhat up to police interpretation? For example, if a police officer sees you go over the line a couple of times and then noticed that you are on a cell phone, that could be 2 separate charges, if he wants. So what does this do, add a 3rd charge so the state collects more money? Or is this just NJ catching up to other states?

Well in New Jersey if a cop sees you with a cell phone, while driving, you are getting a ticket if he chooses. So from the looks of it, if this law passes, you could be pulled over and ticketed for holding a hamburger-- even if you weren't swerving or going over the line, as you described.

It would be interesting if people had the spine to challenge the way this is written.

It doesn't say "potentially interferes." The officer would need to demonstrate that my eating an apple at a stoplight interferes with the safe operation of my motor vehicle. It does not say "is statistically shown to interfere." This means the standard needs to be applied to my specific circumstance.

Of course, no, that's not how it will be applied.

I could have sworn that causing damage while driving unsafely was already against the law.

Very true. There is not a thing that scares me more as it relates to my driving. I'm one of those people who will do the double-sneeze from time to time. When you do that, you're not able to really watch the road, and it's for longer than you think. Every other "distraction" is one I can control.

Legislation to stop what? This legislation isn't intended to stop anything except boredom by police :) There are only 2 possible reasons for the legislation. So that something is done and so that the state gets more money. NJ has the highest taxes in the nation, but still, it's easier to increase fees and add additional charges to problem drivers than increase taxes.

The liberty answer is that whatever the problem, initiating force is not the solution. Legislation may stop unwise behavior, or maybe not, but that doesn't mean curbing everybody's freedom is the way to handle it. If people "shouldn't be doing something," it doesn't necessarily follow that government should be "doing something" about it.

As if being allowed to eat and put up makeup is a Permission for the Govt to grant or deny. When you wish for that, you also wish that Govt has the power to give you permission to observe non MSM media, and total control over every other aspect of your life.

If putting on makeup and eating while you're driving automatically makes your driving terrible, then the problem is already solved by other laws. Your terrible driving cannot be predicted by unrelated behavior. It should be so self-evident that it, in fact, leads to accidents (whether single or multi-car), and those are already "wrong" as they inflict property damage that the initiating party is responsible for.

In other words, not all people eating while "driving" (and this includes stoplights, or standstill traffic, if the past is any indicator) are driving poorly.
Not all people driving poorly cause accidents.

BUT!

All people that cause accidents should be liable for damage they cause.

That works fine for me. All of this pre-emptive policing is just lining the coffers.

Note: they did not specifically say that you could not masterbate while driving. Just come up with an excuse of why it is necessary for the operation of your motor vehicle and you should be safe!

I agree. I don't think the gub'ment should do anything about it. I'm just saying that people should not being doing these two things anyways.

People should know better than to put makeup on while driving (or put clown makeup on in general).

He sounds groggy on the radio recordings because they just got him up.

After the fact, he did everything right, and actually prevented it from becoming much worse.

It should be like seat belt laws in 49 states. Even if you can is in Park, as long as the car is on, you are not allowed to adjust the volume. You must completely turn off your park to play with your radio. And that goes for controls on the wheel too!

No Law can make an Irresponsible person behave Responsibly. All that can be done is that the Irresponsible person is fined, which becomes a source of profit, and incentive to pass more laws under the same false pretenses.
