Just suppose out there in fantasy land, the investigation takes a while to grind through the House, the Republicans win control of the Senate and then Holder is impeached.

Impeachment happens in the House, so they can impeach him without the Senate. The Senate probably wouldn't bother trying him or they would just find him innocent of all charges.


The impeachment process is a two-step procedure. The House of Representatives must first pass, by a simple majority of those present and voting, articles of impeachment, which constitute the formal allegation or allegations. Upon passage, the defendant has been "impeached". Next, the Senate tries the accused.

My understanding on the subject was that after the House Judiciary Committee voted to affirm the Articles of Impeachment it needed a simple majority of the entire House. Am I mistaken? After that, if I recall correctly it is 60 votes from the Senate to enact their removal? And then even after that it is a prosecutor willing to stand their ground to file charges with consequences greater than removing one from the government tit?

The procedure is a little vague and I haven't read too much into it, so if you could explain the way it works I'd greatly appreciate it.

It requires a simply majority of those present in the House to pass. Then the Senate tries the impeached and that requires a 2/3 majority to convict.
