Is Secession Legal?

A fun little chat with Brion McClanahan, author of The Founding Fathers’ Guide to the Constitution (http://www.amazon.com/gp/product/1596981938/ref=as_li_qf_sp_asin_il_tl?ie=UTF8&tag=thomacom-20&linkCode=as2&camp=1789&creative=9325&creativeASIN=1596981938). (Next month, incidentally, I’ve been asked to speak (http://www.tomwoods.com/events) on secession at St. Louis University School of Law.)

It's only treason if you lose.

LOL. ^This. It's like asking "Is rebellion legal?" We rebelled against Britain. Had we lost, George Washington and the lot of them would have been hung as traitors to the crown had they been caught. The real questions should be:

1) Can you take action X without risking war
2) If there is a war after you take action X can you win
3) Are circumstances so bad that if you don't take action X you'll be as bad off as if you went to war and lost

These academic discussions on whether or not secession is "legal" are silly IMO. The U.S. government was made to back down before without war. Here's how.

Precisely!
