I grew up in Garland Texas (where this took place). And everyone in the DFW area knows which suburbs of Dallas have the worst police. Garland Police has been at the top of that list (as #1) with most people who have voiced their opinion for at least 30 years, stating that they find Garland Police to be the most disagreeable. Garland is where previously fired cops go for employment. All of them should be locked into a burning portable toilet.

I'm guessing, as usual, there was no indictment. Can't blame that one on "Just Us" -- it would be a great way for the people to hold them accountable, but we won't do it.

MESQUITE, Texas (AP) Cellphone videos and pictures allegedly recorded at the scene where a police officer killed a suspect by firing more than 40 times are in the hands of investigators.

Garland police officer Patrick Tuter allegedly said he shot in self-defense at Michael Vincent Allen following a high-speed chase near Dallas last month. Authorities initially reported that the 25-year-old Allen struck the officer's cruiser with his truck, but a dashboard camera video showed Tuter's patrol car ramming Allen.


Investigators obtained a court order to confiscate the memory chip from a cellphone that may have taken more videos and photos. Mesquite police are handling the criminal investigation and did not immediately return a phone message Thursday.


Tuter has been put on restricted duty.

A witness told the news outlet he was awakened by the shots and took pictures and video of what unfolded on his cell phone. However, the man claims the Mesquite police took his phone and deleted the footage before returning the device four days later.

The Associated Press reports (http://www.sfgate.com/news/article/Phone-may-have-recorded-scene-of-police-shooting-3862292.php) investigators did obtain a court order to confiscate a memory chip from a cell phone with footage of the incident.

Police then flipped Allen onto his front and checked his pulse,

Judge raises bail to $100,000 for ex-Garland police officer charged with manslaughter

A Dallas County judge this morning set a $100,000 bail for the former Garland police officer charged with manslaughter, even though prosecutors were willing to accept as low as $10,000.

Judge Lena Levario refused to lower the bail amount at a bond hearing this morning for 33-year-old Patrick Tuter, who is accused of killing a fleeing suspect when he shot at him 41 times in August 2012. Tuter was indicted Monday on a charge of manslaughter, the first time in more than 15 years that a Dallas County grand jury indicted an officer in a fatal shooting.

The standard bail amount on a manslaughter charge is $25,000, but prosecutors said they agreed to a $10,000 bail because they didn’t believe Tuter would flee. They said he had been cooperative in the criminal and internal police investigations, as well as the District Attorney’s own investigation.

But Levario said: “I’m not concerned about whether he is going to return to court or not. I’m concerned about public safety.”

Tuter is accused of engaging in a half-hour chase that exceeded 100 miles per hour to track down Michael Vincent Allen, 25, near midnight on Aug. 31, 2012. Tuter’s squad car eventually crashed into Allen’s truck and Tuter opened fire, shooting 41 times and reloading twice.

Levario pointed out that the only other officer on scene did not fire, and also sought refuge from the bullets behind his patrol car. Defense attorneys said the other officer was never in any real danger.

Allen, who had a criminal history and was on the run from Sachse police, was struck three times and died of his gunshot wounds.

Garland police fired Tuter earlier this year after concluding that he had violated the department’s use-of-force and pursuit policies. Levario said based on that, and considering that Tuter had violated department policy once before, she believed he could be a risk to the public.

As a condition of the $100,000 bail, Tuter cannot work as a police officer or hold any job that requires him to use a weapon. Well, I guessed wrong -- he has been indicted. It should be for "murder" , not manslaughter though. The JustUs system will see to it that he gets the bare minimum if he's convicted I'm sure ...

Prosecutors said they did not consider the fired Garland police officer a threat to flee, and were prepared to let bail go as low as $10,000. But Judge Lena Levario said that in her view, Tuter (pictured) posed a threat to public safety and needed to be locked up. Typical bail in manslaughter cases is about $25,000, the Dallas Morning News reported.

If he makes bail, Tuter is not allowed to hold any job that requires him to use a weapon.

Yeah, but the cop may have pulled the trigger by accident. Why else would he be charged with manslaughter and not murder.
