In recent years, more and more parents are deciding to opt out of the federal government-run public education system for various reasons but normally including the fact that standardization is not working for some students.

During the 2011-2012 school year the Thacker family of Nebraska decided to homeschool their child starting in November, applied to their state’s Department of Education to do so, and had planned on providing more than 1,300 hours of education for their children.

Unfortunately for the Thacker family, they received a court summons before their application was even taken into account because their children hadn’t begun attending public school when the public school year started.

The family was represented by the Home School Legal Defense Association (HSLDA) and shot back at the state after the NDE charged the Thackers with absenteeism on behalf of their children for every single day since the public school curriculum began. WND reported that, “HSLDA attorneys found two glaring problems with the state’s case: How could the Thackers be charged with absences from a public school that their children were never enrolled in? Secondly, the state requires every kind of school to provide 1,032 hours of instruction sometime during the school year, but does not dictate the start or the end date.”

An appeal and some arguments later, the Justices finally concluded, “We agree with the Thackers…Under the law as written, we do not agree that a child must be attending a recognized exempt school each day of the public school calendar year.”
