It's just a logical extension of a line of United Statist reasoning that is becoming more popular:

"The 2nd Amendment doesn't protect "rapid fire assault rifles" because they weren't around when it was written"

"The 1st Amendment doesn't cover "rapid fire information dissemination" because it wasn't around back then"
