Mounting pressure from national media and the local community still has not convinced California police to offer any explanation for why they confiscated cell phone video taken by witnesses who say eight or nine officers beat a helpless man to death.

The Kern County Sherriff’s Office has responded to allegations of police brutality only by stonewalling reporters and the family of David Silva, 33, who died last week after witnesses say police took turns hitting the supposedly inebriated man in the head with their batons. Observers who phoned 911 to report the police abuse were later visited by detectives demanding they turn over any footage captured in the early morning hours of Wednesday, May 8.

The seven Kern County deputies officials say were involved in the incident (the number of California Highway Patrol officers present is still unknown) have not been placed on administrative leave, according to the Bakersfield Californian, and department officials have refused to explain why.

“We’re following the same protocol, as far as the administrative process is concerned, that we’d follow in similar-type incidents,” said sheriff’s spokesman Ray Pruitt. Other law enforcement higher-ups echoed a similar sentiment by implying their silence was warranted by an “ongoing investigation” that could last for months.

The cause of death will be announced pending a toxicology report from the coroner as well as microscopic studies. But the delay in explanations fail to account for why witnesses told local and national media outlets that Silva appeared to die in front of them, after a police beating and while a canine unit looked on, apparently ready to intervene if Silva would have been allowed to stand.

Melissa Quair told the Bakersfield Californian that aggressive deputies showed up at her door and blocked the exit as they seized her boyfriend’s phone, which contained video of the beating. She also asserted that her mother was forced to forfeit her phone, even after the police were told it did not contain any supposed evidence.

“They used more force than was needed,” Quair said. “I told them that they didn’t have permission to say who could go in or out of my house. My mom is disabled and has a lot of doctor and medical numbers stored in her phone. But the detective didn’t care and they told my mom to write all her contacts down on a piece of paper and while she did they watched her like hawks.”

Only one poorly-lit video of the beating has surfaced, but 19 blows are visibly delivered by three officers.

I guess they figure that if they can roast a man alive on national TV, they can do anything they want.

The only one I've seen is a very poor quality one from a security camera,, at a distance.

I don't think that requires much Lab Testing.

I think they're figuring correctly.

I've been distracted lately, what is the roasting comment in reference to?
Its getting more and more hard to not automatically assume (which I think it a tad wrong) that someone is a bad person just because they're a police officer.

I don't think being in the force is bad in and of itself but seems that someone that had true respect for the rule of law, individual rights, etc. wouldn't be allowed to stay on the force for long ... which, to me, makes me feel that chances are - despite what a good ole boy they seem to be - police are not to be trusted.

Stuff like this doesn't go down in every town all the time, this is a pretty severely corrupt case. Tons of smaller stuff goes on regularly though.

My daughter has a bib that my wife got for free ... its a 'police insurance' company. Their logo says "each others keeper" ... gave me a chuckle how much I agreed.

I'm sure they've already determined that but are waiting for a full report before releasing any of the details inside it. Him being beaten while drunk (for example, I haven't read anything to say he was) could have caused death where a sober person would have survived ... but been pretty bad off if it got to that point.

I'm not a doctor. I just know the rule 'don't drink while you're bleeding'.

You can get the just of it. If you notice at 1:15 a cop calmy walks up and shoots Silva with a taser.

They killed that man. Smdh.

They'll call it a homicide. I have no doubts. They'll just 'justify' it. The video that was erased probably showed something clear about how unjustifiable it was. If you watch carefully though, the cop's demeanors are telling. The one pig walks up slowly and calmly, pulls out his taser, and shoots the victim. They weren't being overpowered or anything. The man very well could have been trying to comply. They just wanted to beat his ass. That many people with steel poles and tasers, it's not too surprising they beat him to death.

I'd like nothing more than the cops to fry. Lethal injection isn't enough. Not that I really think they'll ever be charged with capital murder.

one of the cops has the same last name as a cop that was involved in a police brutality case last year in which the victim got 4.5 million dollars

Why does 'the city' pay out any claims against bent police? Why can't the police take out a bond as part of their employment and any proved claim against them is forfeit from that?The insurer would demand good training and regular evaluation of their psychological state.

Now when you witness and record a crime being committed by the men in blue, you also need to have with you TWO phones.

#1 to record the criminal activity.
#2 the dummy phone to hand over to them...or else have the same activity committed on you.

Or if somehow you leave the scene and make it home...Time to make some fucking backup video ASAP! And start saving all your contacts, and DELETING all EMAILS, TEXTS, and who knows what else, they might take and then somehow use that information against you.



This is worse then the Mafia.

You witnessed the Mafia OFF someone....They show up at your house...Intimidate you and make you hand over the video...Now they have your most personal details...EVERYTHING about you. Your most personal messages, emails, pictures, who you talk to, everything, which they can use in who knows what twisted way.

Worse yet, what if they really didn't like you? What's to stop them while they have confiscated your property...to uploading some LEWD child porn pics on your phone and now you are going to jail for eternity and hated by the general public and all mankind...Think anyone has sympathy for a sicko who's into child porn? Get ready to be raped and beaten and everyone will say, "That sick dude deserved it...."

So you went from witnessing a crime and trying to do the right thing, to going to ass rape prison for the rest of your life....

The thought of a Gestapo taking your phone is really really scary.
