City restaurant inspectors will now be armed with 17-ounce cups to make sure eateries aren't selling oversized sugary beverages

New procedures give restaurant inspectors cups that can hold 17 fluid ounces and they'll be instructed to issue a violation only when a cup is found to 'clearly exceed' 16 ounces.

The Health Department plans to use regular restaurant inspections to make sure eateries are not selling sugary beverages in servings larger than 16 ounces. But the inspectors will have specially ordered cups to help them enforce the new rule, Deputy Health Commissioner Daniel Kass said.

He spelled out the new procedures in exacting detail in an affidavit recently filed as part of the legal challenge to Bloomberg’s anti-big-soda policy. “The measuring cups that we will be issuing ... will be able to contain 17 fluid ounces,” Kass said. Inspectors will be instructed to issue a violation only when a cup is found to “clearly exceed” 16 ounces “when measured in the inspector’s measuring cup,” he added.

Can these restaurants serve sugary beverages in 14 oz cups and just give free refills? Or buy one get one free? Or invent a cup that is just two cups joined together. Not sure what the law actually reads, but I'd be looking for loopholes just for the hell of it if I lived there.

With this new law can you just sell "cups" empty cups then have a self serve machine where they can fill those cups? Or how is it worded?

That's what I'm wondering.....what if a patron smuggles in a 16 ounce cup and after paying, they use the illegal cup and an inspector walks in! Who gets busted? The patron? The restaurant? Both? If the restaurant is liable Will restaurants then require TSA security to make sure no banned beverage holders make it inside??

Thank goodness, if it holds up as a decision. The LP here will nonetheless proceed to develop initiatives on all the control freak fronts, to contain or remove the Mayor's powers to perform this kind of capricious tyranny on any front.
