There is a major lawsuit hearing today on emergency motion brought by the Obama administration to overturn a lower court ruling finding indefinite detention of citizens without trial to be unconstitutional. These senators are sitting by the Obama attorneys to fight for it.

Seems to me this should create a senate opening in New Hampshire.

The senators themselves are not expected at the hearing. But they have been granted time during oral arguments in addition to the Justice Department attorneys defending the case by arguing they wanted to defend the merits of the law itself and not just win the lawsuit.

It's a shame Sarah Palin had to go to NH and endorse Ayotte in her primary against Ovide Lamontagne. We could have had another Rand Paul in the Senate. Instead, we got John McCain's Senate "daughter" who will carry on his "legacy."

The Hill article is trying to paint Obama as hating NDAA and reluctantly backing down from a veto.... but doesn't explain the EMERGENCY motion to overturn the ruling wiping out these provisions, which many are assuming means Obama has already started using them.
