Former Rep. Tom Tancredo (R-Colo.) said he will uphold his end of a bet and smoke marijuana now that the drug has been legalized by a Colorado voting referendum.

The former congressman and anti-illegal immigration activist had told the maker of a documentary about the ballot initiative that he would smoke pot if the measure passed, despite not being a drug user. On Nov. 6, Colorado voters approved marijuana for recreational use 55 percent to 45 percent.

"Look, I made a bet with the producer of the film that if Amendment 64 passed (I did not think it would) that I would smoke pot," Tancredo said in a statement to Fox News. "I will therefore smoke pot under circumstances we both agree are legal under Colorado law. Hey, it's better than having to do a stupid dance as (Denver) Mayor (Michael) Hancock must perform as a result of losing a bet on the Broncos beating the Ravens."

OMG! tancredo the drug warrior? Smoking pot? This literally has to be seen to be believed! Someone HAS to get this epic and classic event on video! For some reason, I just can't for the life of me ever imagine tancredo becoming a poster boy for norml. It's about as surreal as obomba winning the nobel peace prize or the ghoul calling for an end to the police state. I nominate SB to be the one to light the joint or bong for him. Kenny, have you volunteered yet?

Tancredo is not a drug warrior. He supports legal marijuana and has called the drug war a failure, and has been doing so for years (http://stopthedrugwar.org/chronicle/2009/may/22/drug_legalization_conservative_c).

Sorry, he's a welcher.

Former Rep. Tom Tancredo’s promise to smoke marijuana has gone up in smoke.

Tancredo is backing out of a bet that required him to smoke marijuana with a documentary filmmaker if voters in his home state legalized the measure in a November referendum. (The measure passed easily.) While Tancredo said earlier this month he would follow through, his wife’s opposition led him to change his mind.

“My wife is absolutely — she’s pissed,” the Colorado Republican told ABC News. “Oh man, she is not happy.”

He's taking a stand for state's rights. He does believe what he believes, and he is daring them to arrest him. This particular point I consider admirable.

I'm more surprised that he even made the bet than I am that he welched.

What kind of job does he have these days that isn't piss or hair follicle testing him?

I'd do it in his stead, but cannot.

It is prohibited.

And if he did, he would also be a "prohibited person" WRT to his firearms.

That is probably why he is backing out, not his wife bitching at him.

That only applies to habitual users and addicts. One-time use doesn't fall within that.

It's so stupid. We have so many legal drugs that screw you up so much more than a little pot—yet this medicinal plant gets such a bad rap.

Transfer Form 4473

Question 11-e asks if you are an "unlawful user of...marijuana".

Since federal law prohibits the use/possession of marijuana, if you use or have used pot you are a prohibited person.

The only wiggle room is how "user" is defined.

Good luck trying that while you sit in jail for years.

Well, you could be a victim of your own honesty. This is one of those things that you have to be careful about. What can they and cannot prove....

Since federal law prohibits the use/possession of marijuana, if you use or have used pot you are a prohibited person.

The only wiggle room is how "user" is defined.

From the ATF:

Unlawful user of or addicted to any controlled substance. A person who uses a controlled substance and has lost the power of self-control with reference to the use of the controlled substance; and any person who is a current user of a controlled substance in a manner other than as prescribed by a licensed physician. Such use is not limited to the use of drugs on a particular day, or within a matter of days or weeks before, but rather that the unlawful use has occurred recently enough to indicate that the individual is actively engaged in such conduct. A person may be an unlawful current user of a controlled substance even though the substance is not being used at the precise time the person seeks to acquire a firearm or receives or possesses a firearm. An inference of current use may be drawn from evidence of a recent use or possession of a controlled substance or a pattern of use or possession that reasonably covers the present time, e.g., a conviction for use or possession of a controlled substance within the past year, or multiple arrests for such offenses within the past five years if the most recent arrest occurred within the past year.

Tancredo clearly does not fall within that definition.

Good luck trying that while you sit in jail for years.

Possession of marijuana is not a felony under federal law.
