According to a police report, Officer Nicolas Juarez was assisting fellow Officer Cavazos with a traffic stop where a male was placed under arrest. While Officer Cavazos was conducting the arrest and waiting for a wrecker, Officer Juarez noticed a male, identified as Cabrera, standing by the railroad tracks and video recording the arrest.

Juarez walked towards Cabrera in an attempt to identify who he was due to him being a witness to the arrest and to see if Cabrera was in any way related to the subject that was arrested for the traffic stop.

As Juarez began to approach Cabrera, he began yelling “you're on private property!”. Juarez approached Cabrera and asked him for identification at which time Cabrera failed to identify.

After asking Cabrera two more times, Cabrera stated he did not have to identify himself to the officer. Juarez advised Cabrera that he was going to be placed under arrest at this time. Juarez collected Cabrera's cell phone as evidence since it recorded Cabrera stating he did not have to identify himself to the officer.


The cell phone was logged in the evidence locker
and no further action was taken.

No complaints have been filed against the officer or the department. Media reports said the officer arrested Cabrera for video taping the arrest but police officers only charged him with failure to identify.

The video was posted on Youtube and has already had over 3,000 views since its publication on Dec. 21. Cabrera states in the description of the video, “I was wrongfully arrested while I was at work. I was taking a break and decided to record a traffic stop that was off the highway a good 60 ft away and was then approached by an Alice Police officer who I advised that he was trespassing onto Private Property he then demanded to see my ID and that's when things took a turn for the worst..!!! I WAS UNLAWFULLY ARRESTED FOR FAILURE TO ID.”

A press release was issued Friday afternoon from the police department stating, “although an external formal complain has not been received regarding a recorded arrest which took place on Dec. 19, the Alice Police Department has initiated an internal complaint and investigation into it. In an effort to ensure the integrity of the investigative process, and to avoid any appearance of impropriety, the investigation has been outsourced to an independent investigator. As is customary with investigations of a police officer, the officer has been placed on administrative leave pending the outcome of the investigation.”







I'm talking arrested and confiscated personal shit out of a law abiding citizen's hands on private property.



Texas does not even have a "Stop and ID" statute and those states that do almost unanimously add the clause:




whom he reasonably suspects is committing, has committed or is about to commit a felony or other public offense and may demand of him his name
