Court: Feds promised NOT to enforce 'mandate'


Religious organizations and business owners who object to Obamacare’s mandate to pay for abortifacients have been handed a huge victory, with a court concluding the government already has promised it never will enforce those provisions against them.

“The government … represented to the court that it would never enforce [the mandate] in its current form against the appellants or those similarly situated as regards contraceptive services,” said an order released by U.S. Court of Appeals for the District of Columbia.

The three-judge panel said the government said there will be “a different rule for entities like the appellants … and we take that as a binding commitment.”

“The government further represented that it would publish a Notice of Proposed Rulemaking for the new rule in the first quarter of 2013 and would issue a new Final Rule before August 2013.”

The judges continued: “We take the government at its word and will hold it to it.”

Good news. This will definitely end up with SCOTUS, though. Hopefully they do rule that those of us who object to immoral practices such as contraception aren't forced to compromise our deep held beliefs and pay for them.

Just because we still haven't doesn't mean it isn't temporary. I doubt there will be an income tax in FEMA camps.

Yeah, yeah, they said Social Security was voluntary in the beginning too.

And they also said the Obamacare fine wasn't a tax, so they could "pass" it in reconciliation IIRC.

The whole "it's not a tax" and then SCOTUS ruling it's only constitutional as a tax will be the downfall of Obamacare. All tax bills must originate in the House, but Obamacare originated in the Senate.


All bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

Obamacare originated in the Senate.

Don't be so sure. Florida prisons charge their inmates a monthly fee to handle their inmate bank account, even if the inmate has no money. So, if you have a destitute friend in a FLorida prison who hasn't had a visitor or cash gifts for years, and you debate sending him $50 for Christmas...you shouldn't. The state keeps it all to offset the balance he's incurred over the years of them charging $3 a month to handle 0 transactions.

huh? So they said gov claimed they won't enforce the law, so let's leave it a law? Or do I not understand what they are saying?

Looks like judicial chaos. I'm not sure that's a bad thing when the laws are so bad.

Yeah, but it's pretty clear that the GOP isn't going to take advantage of this, ad SCOTUS will rule that you and I don't actually have standing.
