This most certainly was NOT simple assault. It was battery.

Assault is an attempted battery or the act of intentionally placing a person in apprehension of a harmful or offensive contact with his or her person.

In some places, assault is the threat of violence against another while aggravated assault is the threat with the clear and present ability and willingness to carry it out. Likewise, battery is undesired touching of another, while aggravated battery is touching of another with or without a tool or weapon with attempt to harm or restrain.

Rochelle Bilal, president of the Guardian Civic League, an organization of black police officers, said she thought Josey erred in striking Guzman. But she also has criticized Ramsey's swift decision to fire Josey, saying he could have received a lighter punishment, such as a suspension without pay.


That'll teach them!


John McNesby, president of Fraternal Order of Police Lodge 5, the largest officers' union, said the organization would continue to support Josey and appeal to get him reinstated.

Where are the good cops agreeing with the removal of this criminal???

I've explained this before... Different states charge 'battery' as assault. Yes I know the dictionary definition but in Ohio for example, if you punch someone in the face it is simple assault- a M1 misdemeanor punishable by no more than 180 days in jail. I would assume that this is the same punishment as PA. (You'll never do 180 days.. usually 20 days with a suspended sentence and probation. I don't expect this cop to get any jail time. Anger management classes and 3 years probation with a clause that should he violate he will do the 180 days on top of the new charge. I'd be willing to bet on this scenario)
