Judge Betzy Ortiz, of the Court of Bayamón, found no cause to arrest Sergeant Carlos Marrero Nunez for shooting at an alleged assailant, who was also released.
Data collected revealed that Sergeant Carlos Marrero Nunez, who was on his day off, realized that a subject left the store with stolen merchandise. The officer ordered the subject to stop, but when the alleged assailant ignored his commands, the police officer opened fire.
The alleged assailant was not hit by the officer. He was subsequently arrested.
The case was discussed with prosecutor Ruth Gonzalez, who ordered a complaint be prepare against Marrero Nunez(the cop) for violation of the Arms Act. The case was brought before the presence of Judge Betzy Ortiz. Upon hearing the evidence presented, Ortiz did not determine cause, releasing the Sgt.
Meanwhile, no charges will be filed against the individual involved in the incident, because, at the time of his arrest, he was not carrying any of the alleged stolen merchandise.
