The bottled water industry vowed to keep fighting Concord’s first-in-the-nation plastic bottle ban after the controversial measure won final approval from the state attorney general’s office yesterday.

The International Bottled Water Association, which represents 640 U.S. and international bottlers, distributors and suppliers, said it is “exploring all available options to continue to oppose the bylaw,” which won town approval in April by a mere 39 votes — after three tries.

“This ban deprives residents of ... their choice of beverage, and visitors, who come to this birthplace of American independence, a basic freedom gifted to them by the actions in this town more than 200 years ago,” the organization said in a statement. “It will also deprive the town of needed tax revenue and harm local businesses that rely on bottled water sales.”

The ban on sales goes into effect Jan. 1, and focuses strictly on water served in one-liter plastic bottles or less. Anyone who violates the new law faces a warning the first time, a $25 fine the second time and $50 fines for each subsequent offense.

The law allows businesses to sell single-serve plastic water bottles in emergency situations, and Concord Town Manager Chris Whelan said it can be suspended permanently through an “escape clause” if the cost of implementing and enforcing it becomes unreasonable.

Concord resident and bottle ban booster Jean Hill told the Herald she spent three years revising the bylaw, which is intended to help the environment, and wasn’t worried about potential legal action from the bottled water industry.
