Looks like the legalization initiatives in Colorado and Oregon have a real good chance to pass according to some recent polls, this may get very interesting. Does anyone know of any other marijuana reform initiatives on the ballot in November? Or even any other broader drug reform or local city-wide drug reform initiatives, post them in this thread if you know of any.

Colorado: Amendment 64 (marijuana legalization)

Amendment 64 would allow adults 21 and over to possess up to an ounce of marijuana or six marijuana plants, three of which could be mature. It would create a system of state-licensed cultivation, manufacturing, and testing facilities and state-licensed retail stores. Local governments would have the option of regulating or prohibiting such facilities. The amendment would also require the state legislature to enact legislation governing industrial hemp cultivation, processing, and sale, and to create an excise tax on wholesale marijuana sales. The first $40 million of that annual revenue would be dedicated to building public schools.

Washington: Initiative 502 (marijuana legalization)

Initiative 502 would legalize the possession of up to an ounce of marijuana by adults 21 and over, but does not allow for personal cultivation, except by or for medical marijuana patients. It would license marijuana cultivation and retail and wholesale sales, with restrictions on advertising. Regulation would be the remit of the state liquor control board, which would have to come up with rules by December 2013. The measure would create a 25% excise tax on marijuana sales, with 40% of revenues dedicated to the general fund and 60% dedicated to substance abuse prevention, research, and healthcare. It would create a per se driving under the influence standard of 5 nanograms of THC per milliliter of blood.

Oregon: Measure 80 (marijuana legalization)

Measure 80, the Oregon Cannabis Tax Act (OCTA), would create an Oregon Cannabis Commission to regulate the cultivation and sale of marijuana, but not industrial hemp, which would be allowed, but not regulated by the commission. The commission would grant licenses to cultivate marijuana for sale to it by "all qualified applicants" and would sell marijuana at state retail stores at prices it determines. Medical marijuana patients would have their medicine provided at cost. The OCTA would supersede all state and local laws regarding marijuana, except for impaired driving laws, leaving personal possession and cultivation by adults unregulated.

Question 3 would allow people suffering from a debilitating medical condition to use medical marijuana upon the recommendation of a doctor with whom they have a bona fide relationship. Patients could possess up to a 60-day supply -- what constitutes that supply will be determined by the Department of Health. The initiative would also set up a system of nonprofit medical marijuana cultivation and distribution centers.

Issue 5 would allow patients suffering from specified diseases or medical conditions to use marijuana with a doctor's recommendation. It envisions a system of state-licensed nonprofit dispensaries, and would allow patients or their caregivers to grow their own only if they are not within five miles of a dispensary. In that case, patients could grow up to six flowering plants. Patients could possess up to 2 ˝ ounces of marijuana.

Initiative Referendum 124 would undo the gutting of the state's medical marijuana program through the passage last year of Senate Bill 423. That bill replaced the voter-approved medical marijuana program, which allowed for dispensary sales, with a new scheme that limited providers to serving only three patients, prohibited providers from accepting anything of value in exchange for products or services, granted local governments the power to regulate providers, tightened standards for demonstrating chronic pain, and demanded reviews of doctors who certified more than 25 patients in a one-year period.

California - A number of towns, mostly in the San Diego area, will vote on local initiatives to allow medical marijuana dispensaries. Those include Del Mar, Imperial Beach, Lemon Grove, and Solana Beach, as well as Palo Alto. The town of Dunsmuir will vote on whether to loosen cultivation regulations.

RESULTS: Measures in Del Mar, Imperial Beach, Lemon Grove, and Solana Beach to allow dispensaries all FAILED by a relatively wide margin. Colorado - Berthoud will be voting on whether to ban dispensaries, and Fort Collins will be voting on whether to overturn the ban on dispensaries voted in last November.

RESULTS: Berthoud's measure FAILED with only 43% (http://www.reporterherald.com/news/larimer-county/ci_21943723/unofficial-numbers-show-berthoud-question-300-fails) supporting a ban on dispensaries. The measure in Fort Collins to overturn a ban on dispensaries PASSED with 55%.

Massachusetts - In a continuation of work done in the past six election cycles, voters in a number of legislative districts will be asked a non-binding public policy question. In the First Essex and Middlesex Senate District, the Eighth Essex House District, and the Twenty-Second Essex House District voters will be asked whether they support repeal of the "federal prohibition of marijuana, as the 21st Amendment repealed national prohibition of alcohol, so that states may regulate it as they choose?" Voters in the Second Middlesex Senate District, the Middlesex and Suffolk Senate District, and the Second Berkshire House District will answer a similar question.

Washington - Voters in six cities -- Bellingham, Bremerton, Everett, Kent, Olympia, and Spokane -- will vote on initiatives to make marijuana the lowest law enforcement priority and prohibit local officials from cooperating with federal marijuana law enforcement activities.

RESULTS: couldn't find any information, but marijuana is now legal in WA anyways

they said the same thing in CA last cycle. It was polling favorably for the whole damn election cycle and in the last 2 weeks the favorability tanked and it didn't end up passing. I'm hoping that doesn't happen again but i'm not counting on it getting passed in any state yet.

I think what would be even MORE interesting is how would the President deal with a state that has legalized and regulated marijuana. Would a president Obama who no longer is seeking reelection crackdown on state-licenses marijuana dispensaries or not? I have no doubt Mitt would break-up the party.

I heard that Washington's is facing some backlash from the medical community because of the limits on driving (since it stays in your system for so long none of them could drive) and things might turn out like California did.

They're just now drafting the bill for MMJ in NC. Better late than never I guess?

The measure has garnered opposition from the medical cannabis community, and some say its driving-under-the-influence provisions are so strict that it could prevent them from driving at all.

Others say the measure doesn't go far enough because it wouldn't allow people to grow their own pot for recreational use, although medical patients still could; it doesn't contemplate the industrial growing of hemp; and it would not allow recreational use for those between 18 and 21.

Because of the split, Hempfest - now in its 21st year of advocating legalization - is taking no official position on the measure, something McPeak called "very painful and very awkward."

Alison Holcomb, campaign manager for the measure's sponsor, New Approach Washington, said she was disappointed, too.

"We've got a legalization measure on the ballot right now," Holcomb said. "Seattle Hempfest, which has been carrying the legalization banner for 21 years, ought to be celebrating."

Both sides of the debate were aired at the festival, as supporters and opponents set up tents and vied for the attention of potential voters.

At the No on I-502 tent, activist Arthur West said he's been attending Hempfest since the late 1990s and never imagined that he'd be here to oppose a legalization measure. But then, he and fellow activist Poppy Sidhu said they don't consider I-502 legalization at all.

"We're all for legalization, but legalization, for me, is being able to grow as much as I want and being able to walk down the street to Starbucks smoking my joint," Sidhu said.

Conner Michaels, 24, of Bellingham, approached with a thick, burning blunt in his hand and asked for a No on I-502 button.

"This is sick," he said. "I'm not going to be able to drive if this passes."

Medical marijuana dispensaries are largely also opposed, in part, because of the licensing requirements in the measure, said Brian Ray, the goateed, dreadlocked owner of One Love Collective, a dispensary in South Seattle. Many dispensaries are doing well under the current system, and there's no reason to rush into a legalization scheme that might be flawed, he said.

"It appears like it's going to shut down the entrepreneurial spirit of these small businesses," Ray said.

Thanks, I didn't know about that one. It is an effort to get medical marijuana on the ballot in Arkansas, and it looks like they have collected enough valid signatures.


Medical marijuana push submits 74,000 more signatures

A group pushing to legalize medicinal marijuana turned in an additional 74,406 signatures today in what supporters hoped would be enough to qualify the proposal for the November ballot.

The group, Arkansans for Compassionate Care, fell about 26,000 signatures short of a required 62,507 valid voter signatures on July 6. With the new collection effort, their odds are good that the proposal will qualify for voter consideration.

The medical marijuana proposal would allow for up to 30 nonprofit dispensaries in Arkansas. Local cities and counties could choose to ban them.

Marijuana would only be available to people with a prescription for certain health conditions, including cancer, glaucoma, Hepatitis C, HIV/AIDs, Alzheimer’s disease and several other conditions. The proposal allows for a patient to have up to 2.5 ounces of usable marijuana without the threat of prosecution.

ND likely to debate medical marijuana proposal

BISMARCK, N.D. — North Dakota voters are likely to have a chance this fall to decide whether marijuana may be used legally as a pain reliever, an option the Legislature has never addressed and that South Dakotans have rejected twice.

Supporters of medical marijuana have been circulating a citizen initiative to put the issue on the November ballot. On Monday, Dave Schwartz, campaign director for a pro-medical marijuana group called North Dakotans for Compassionate Care, delivered petitions that he said contained about 20,000 signatures to North Dakota Secretary of State Al Jaeger's office.

The petitions need about 13,500 signatures from North Dakota voters for the initiative to qualify for a vote. Jaeger has about a month to review the petitions and decide whether they are valid.

The measure would allow someone who suffers from cancer, glaucoma, post-traumatic stress disorder and other debilitating illnesses to use marijuana if a doctor recommends it.

So, does this help the HEMP situation? I don't want to be regulated, even though I don't smoke mary-jane anymore, haven't for decades (not that I wouldn't like to, but causes heart palpitations). But I would grow hemp for industrial uses though.

So, does this help the HEMP situation? I don't want to be regulated, even though I don't smoke mary-jane anymore, haven't for decades (not that I wouldn't like to, but causes heart palpitations). But I would grow hemp for industrial uses though.

It seems that only the Oregon Cannabis Tax Act 2012 will restore industrial hemp.

90% of the proceeds will go into the state general fund, 7% for drug treatment programs, 1% each for drug education in public schools, and two new state commissions to promote hemp biofuel and hemp fiber and food

is regulated hemp production better then hemp prohibition?
i would say yes, as once you can get regulated hemp grown, and show people what it is capable producing (food fuel fiber etc), which will help lead to further deregulation. maybe that is just my wishful thinking.


i am more interested what the federal government will do when a states residence vote to legalize cannabis. will they override the citizenry? pull highway funding?
this will get interesting if we see any of these pass.

Dispensaries, and believe me these are the only people against the initiative, have been noting that you can get a DUI if you are driving erratically and have a certain level of THC in your blood. Here's all you need to know. This is a blood-test, i.e. they have to test you at the station. And if you get pulled over currently, you just get a DUI for any level of it. What's the difference? If you are driving erratically and smoked you deserve to get a DUI. Vote I-502!

I updated the OP with a few other polls that were left out, if anyone comes across any more post them and I will add them as well. The support appears to be increasing in both Colorado and Washington, but these marijuana initiatives always seem to take a big hit in the last few weeks when the anti-marijuana scare tactics ramp up. California Proposition 19 was polling pretty well around this time in 2010, but by the beginning of October support had suddenly collapsed and it never returned.

In Springfield, MO there was supposed to be an initiative on the ballot to 1) lower penalties for possession of up to 1 1/4 ounces of cannabis to a maximum $150 fine 2) require the city council to create an oversight committee to monitor implementation of the ordinance and 3) allow automatic expungement of convictions for possession of up to 1 1/4 ounces of cannabis or cannabis paraphernalia two years after a plea of guilty or conviction. The city council in Springfield is up to some shenanigans though and may not allow it to be on the ballot or may water it down, you can read more about it here:

The "favoribility" tanked because thankfully the word got out that Prop 19 was a scam.

The worst thing about prop 19 is that those that were warning that it was bad law were attacked by newbies who didn't know how to read legislation and believed that anything that said "legalize marijuana" was a good thing.


And now we have WA I-502

Wherein growing a single plant would become a felony. and no "private sales" are allowed. And 1 gram over an ounce is treated just like it is TODAY.

Somehow, this is being sold as "legalization". This is a prime example of how the media can mislead well meaning people and turn them on their fellow citizens.

Because, as witnessed by Prop 19, those that try to point out the fact that this initiative would make things worse than the present existing law will be accused of being LEOS, or Lazy Growers, or infiltrators.

WA 502 will make things worse, and if you love freedom you had better hope it fails. Because if an authoritarian law like this passes in one state, others are sure to duplicate it.

The bottom line is that Cannabis is an Herb and anyone in a Free Country should be able to grow whatever they want.

And for the tax crowd, the Government needs to be punished for their lies and the only way to do that is to withhold tax revenue. So F&C* the taxers, at least until this country stops spending $2000 per second bombing and invading foreign lands.

Ditto and here in Fla we're waiting for the other 49 states to completely legalize it and see how it goes for a while before they consider thinking about having a discussion about it it seems.

The reason that lost was that it was a poorly written, mini-corporatist, monopoly creating piece of junk. The pro-marijuana forces opposed it by the time the election came around.

I see where this is going. Only corporations or big pharma will be allowed to grow however much they want.

Looks like that's what is going on with this patent on the use of a part of the Cannabis plant (cannabinoids)
Since a plant itself can't be patented (although Monsanto's lawyers are probably working on that) the "use" of it can, and has been patented. According to at least one doctor, this patent is being used to stifle research.

What is astounding is that apparently no reporter in the nation can take the time or trouble to ask Herr Holder why, if as he states "there is no medical use of Marijuana" the Gov that he represents holds a patent on the use of the plant.

I added some new polls to the OP and have reposted the polling data below, making note of which polls have been added since the last time this thread was updated. Still polling good in Colorado and extremely well in Washington and Massachusetts, but not too well in Montana where the medical marijuana repeal measure has a double digit lead. The most recent poll in Colorado I don't know how much it matters because they did not ask about Amendment 64 specifically, just marijuana legalization in general, and it does not match the other polling data.

I know—if you watch politics around here, you know they're on board and their endorsement seems... banal. Don't be jaded. Former US Attorneys John McKay and Kate Pflaumer, along with the FBI's Charlie Mandigo, make the most persuasive case for legalization: Pot laws result in using limited law enforcement resources that should instead be focused on violent crime.

Every time that pot legalization—even decriminalization—has gone to voters in other states, federal law enforcement have delivered the coup de grace, largely by virtue of their credibility. This time, it's the opposite. These prosecutors and an agent get in the first word for legalization, and with $1 million in the bank and up to $2 million more on the way, the New Approach Washington campaign is going to hit this message hard. This is a coup.

502 is not "legalization". It is a carefully constructed ploy to sell "legalization" to the masses, while giving LEO's and State Licensing Bureaucrats even more authority than they have now. A peek at who is supporting this nonsense might be instructive, unless one has already made up their mind.

Washington voters are being told a big lie. New Approach Washington, the campaign behind Initiative 502, is advertising that it will “legalize” marijuana. It would not.

It creates a very narrow exception that defines the possession of one ounce by adults over 21, and the state’s rules for production, as “not a violation” of the law.

I-502 leaves every single law now making marijuana illegal on the books. Walk out of the state-sanctioned, licensed and taxed store and hand the marijuana to your significant other and it is a delivery of marijuana. This is not comprehensive, real reform.

What I-502 does change is our DUI law. Our current DUI laws are working just fine and result in conviction rates of over 90 percent. This initiative sets unneeded, unasked for and unscientific levels for impairment for adults (5 nanograms, rejected three times by the Colorado Legislature), while establishing a zero-tolerance provision for all drivers 16 to 21.

It also takes away your ability to defend yourself. If you meet the levels, you are guilty. No explaining that you are a patient, no arguing about the levels or tolerance, nothing. For drivers age 16 to 21, any detectable amount of marijuana will result in a DUI conviction and disastrous effects on their parents’ insurance.

This is not based on impairment; it is simply a new penalty for marijuana for kids. But it is a very impactful one for parents with teenage drivers. What parent wants to face the requirements for insurance and the expense of a DUI, all because of some youthful experimentation?...MORE

I would be shocked if these passed.. Actually, the truth of the matter is drugs are reserved for only the wealthy..

I don't think half of the Congress.... and I know Obama/Biden/Holder/Geitner could ever pass a drug test; I would bet my life on that.. Drugs are now the property of the Bourgeoisie . Why do you think our druggies in Obama's Admin. would arm hundreds of drug runners with the most sophisticated weapons out there? To supply their stash... and yet, they throw any one in prison, within the U.S. who wishes to compete.

A new ad released by the pro-pot advocates behind Colorado's Amendment 64 -- a November ballot measure that seeks an end to marijuana prohibition in the state -- features retired, highly decorated 36-year-veteran of the Denver Police Department Lt. Tony Ryan who says the regulation of marijuana will lead to "safer communities."

That's the theme of the second ad from the Campaign to Regulate Marijuana Like Alcohol camp: that marijuana does not lead to violent crime and that by allowing law enforcement to stop focusing on pot busts and instead freeing up their resources to be focused on serious crime, communities in Colorado will be safer.

"In my 36 years as a police officer in Denver, I can't recall a single incident where marijuana was a cause of violence," Ryan says in the spot. Citing data from the FBI Uniform Crime Reports, the ad states that although Ryan says marijuana use did not lead to violent crimes, there have been over 50,000 marijuana arrests in Colorado since 2007.

Ryan goes on to state that he believes regulating the sale of marijuana will allow law enforcement to set new priorities and "direct resources toward serious crime."

Williams, an outspoken supporter of medical marijuana, appeared Thursday at the state Capitol alongside members of Arkansans for Compassionate Care, which is campaigning for Arkansas’ legalization measure on the Nov. 6 ballot. He criticized an ad aired by a conservative group opposing the proposal.

“Offensive is really an understatement. It’s the most egregiously racist, false statement you’ve ever seen in your life,” Williams told a crowd gathered in front of the state Capitol steps. “They’ve people sitting in a picture holding guns, talking about medical marijuana, and of course they happen to be of different colors to make sure you’re as irritated and angry as you can be.”

there was some more shameful anti-marijuana advertisements in Oregon recently, but the billboards pictured below actually got taken down by Clear Channel after people complained it was misleading.

Controversial anti-marijuana billboards around the Portland area featuring a haggard looking child have all been taken down, Clear Channel Outdoor confirmed on Friday.

The eight billboards have been up for about two weeks, said Dan Dhruva, vice president of real estate and public affairs at the Portland branch of Clear Channel Outdoor.

He said Clear Channel decided to remove the billboards after complaints, because it was not clear who was behind the ads. Clear Channel has no position on Ballot Measure 80, which would legalize marijuana.

"The ads protesting marijuana are being removed because our policy is transparency of advertising campaigns and the advertisers who are sponsoring them. These ads include a misleading website that we believe needed to honestly represent the advertiser so the ads are being removed," he said in a prepared statement.

People need to be educated on the difference between hemp and marijuana. Even people in the liberty movement get them confused.

Yes they do. Industrial hemp was selectively bred to have very low levels of THC and high levels of CBD. Conversely, only three percent of cannabis plants can be considered marijuana. Marijuana contains high THC and varied amounts of CBD—depending on strain.

I said it treats it like alcohol. Not beer/Wine, but rather like Hard distilled alcohol. Whiskey, Rum, etc. It is not legal in WA to make your own hard liquor. Still better to have it legally obtainable in state run stores than a blanket ban. Keeps it out of schools and off the roads. If I was the owner of a private road, I would make DUI of alcohol or marijuana a reason to be banished from using my roads. This is a step in the right direction as it WILL seriously cut down on marijuana related gang crime.

new polls look great! less than 2 weeks out and being up by 10 points in CO and 16 in WA! On a side note, I really cannot take seriously any supposed liberty republican not in favor of legalizing marijuana. It has to be the most cut and dry easy litmus test there is.

Support usually decreases as election day approaches and the anti-marijuana scare tactics ramp up, this has been a clear trend over the years for marijuana reform initiatives. But from what I have read recently this is usually true for any type of ballot initiative whether it has to do with marijuana or not, and people that are undecided about a ballot initiative usually end up voting no.

The best example to compare these legalization initiatives to (and the only one that I could find polling data for) is Proposition 19 to legalize marijuana in California in 2010. It was polling well until the beginning of October, then support suddenly collapsed.

We legalized medicinal marijuana in MA tonight.

Owning a small amount for personal recreational use is already decriminalized (but still technically illegal)

I expect we will have a ballot measure like CO in 2014.

Wow, excellent excellent. A step in the right direction. Will tourists to Washington State, Colorado be allowed to purchase small amounts like in amsterdam? Or how amsterdam used to be? I promise my Wife and I will plan a trip and do shopping for other things too. It could be a boon for tourism. How will the obama admin react to this? Will it be legal to use your colorado card in california or hawaii?

RESULTS: Measures in Del Mar, Imperial Beach, Lemon Grove, and Solana Beach to allow dispensaries all FAILED by a relatively wide margin. Massachusetts - In a continuation of work done in the past six election cycles, voters in a number of legislative districts will be asked a non-binding public policy question. In the First Essex and Middlesex Senate District, the Eighth Essex House District, and the Twenty-Second Essex House District voters will be asked whether they support repeal of the "federal prohibition of marijuana, as the 21st Amendment repealed national prohibition of alcohol, so that states may regulate it as they choose?" Voters in the Second Middlesex Senate District, the Middlesex and Suffolk Senate District, and the Second Berkshire House District will answer a similar question.

RESULTS: couldn't find any information, but marijuana is now legal in WA anyways

Even if these initiatives in Colorado and Washington aren't perfect, the important thing is, THE VOTERS PASSED THEM. The process of ending marijuana prohibition on the Federal level will probably take several years--hopefully not too too many--but this is the first step. Now that the people have spoken, and we have two states who "JUST SAY NO" to Federal law, the Federal government will be forced to deal with the issue. I predict more states will follow too.

This is how alcohol prohibition ended. States began voting to re-legalize, and eventually the Feds had no choice but to lift the Federal ban as well. And coincidentally, Colorado was one of the first states to vote to end that prohibition, back in 1932.

I'm so stoked on this!!! The house of cards cannot continue to stand. The whole thing is coming down now. Might take a little time, but there is no stopping it now.
