-- Police shot and killed a man who threatened them with a large knife near Times Square Saturday afternoon.
Officials said the man, who police observed smoking marijuana on 44th Street and 7th Avenue, became agitated when officers approached him. He then pulled out an 11-inch knife and raised it over his head. Officers ordered him to drop the weapon, but he refused, police said.
As the man backed down 7th Avenue, police pepper sprayed him six times to try and disarm him, but the man continued to threaten officers with the knife. Police said that as he neared the corner of 37th Street, he lunged at officers with the knife, forcing them to shoot him. Two officers fired a total of 12 shots, striking the man in the chest, groin, left arm and left calf.
The man was identified Sunday by police as 51-year-old Darrius Kennedy of Hempstead, Long Island.

Police say Kennedy has 10 prior arrests, one of which resulted in him being hospitalized for a psych evaluation in October of 2008, after police took him into custody for knocking garbage cans over in Times Square. In November of 2008 Kennedy was arrested for threatening motorists and cops with a screwdriver on Broadway and West 66 street, police said.
No officers or bystanders were injured in Saturday's incident, which took place in an area crowded with pedestrians.
Witnesses to the shooting described a chaotic scene in Midtown.
"I was standing at the corner of 42nd Street and saw this guy running in middle of street, police chasing him" said Edgar Delgado, who works in the area. "He had a machete type knife. He didn't want to stop. Police told him to drop the knife. He didn't. They shot him."

A witness' cell phone video acquired by NBC 4 New York shows police pursuing the Kennedy along 7th Avenue and then opening fire.
"It was scary because a shooting starts here someone could get hurt quickly," Delgado said.

Watched the video posted,,shows nothing but the guy backing away.,, not very clear.

It was horrible to see it reported on the news, to see the video, and hear the shots. There was no need to fire that progressively... so much for shoot to injure? Not surprised, though, sadly...

Julian Miller, 22, who was visiting New York from Boston, said the police confiscated his phone after he recorded video of the confrontation. He said in an interview that he followed the pursuit from Times Square to 37th Street and Seventh Avenue, his phone recording as he ran to keep up. He said a police detective pulled him aside after the shooting and asked to see his phone and the video.

“His eyes got big when he saw the video,” Mr. Miller said, adding that he had captured the shooting on video. “He went to go show his boss, and then they took my phone away.” He said the officer told him not to speak with the news media.

I heard an AP report on the radio about it. They said he was shot once in the groin and that there were people filming with their phones.

I couldn't see the knife, but if it was pocket knife size to ~13 inches(including handle), a person properly trained in self defense and immobilization techniques could have handled the situation. The "shoot first, ask later" attitude is insane.

Shoot to injure is for the movies, NOBODY trains to do that in real life(regardless of what happened in this case)...

Does it upload photos? I only have a tracfone with a camera. (can't afford fancy phone :( )

it's pretty much aimed at video's. most phones that are linked to something like a Google+ or facebook account will automatically upload your pics that you take to a social networking account... not necessarily instantly - but pretty quickly.

Seems to me like one of the few situations where a taser would be applicable, and they just shoot the guy about ten times?! seriously??

It wasn't exactly point blank. The guy may have been like 10-20 yards from them because he was in the middle of the street, backing away when it happened.

10 yards is 30 ft. 20 yards is 60 feet.
Not from the video I saw. The camera was about 20 yards away. Cops were much closer.

Hard to tell from the video,,, but I guessed 10 feet or less.

That's what it looked like to me also. In my view this was nothing short of murder, sanctioned by the state, justified by the war on drugs.
