Watching things play out with the homosexual community seeking equal treatment as heterosexuals under the equal protection clause it got me thinking.

Why are different income tax rates allowed under the equal protection clause? Should we not all be subject to the same rate, or even the same fixed amount?

The tax law as written applies equally to all, but gives different results based on different circumstances. The equal protection clause does not require that everyone have an equal RESULT under a law, just that the same law applies to everyone. For example, the law against murder puts murderers in jail but not non-murderers. That doesn't violate equal protection.
