Though there are fewer Asian Americans than Hispanics at UT, UT deems Asian Americans “overrepresented” because UT uses state racial demographics as its baseline for determining which minority groups should benefit from its use of race. In other words, although UT includes Asian Americans as minorities in its diversity statistics, marketing materials, and classroom analysis, it employs race in admissions decisions to the detriment of Asian Americans, thus subjecting them to the same inequality as White applicants.
