We have the "smoking gun" on why the government isn't
building the double-layered fence mandated by law.

As we reported to you last week, our government has built just five
miles of the 854 miles of double-layer border fence mandated by
the Secure Fence Act of 2006.

This outrageous fact begs a question...

Why? If the law mandated a double layer fence covering 854 miles,
then how come such little progress has been made?

the citizens of our nation.

As you will see in this report, Congress and the Administration
are pretending to support a real border fence but then working
behind the scenes to ensure that the Secure Fence Act is never
really implemented.

It happened last year, and as I write, Congress is trying to repeat
its Border Fence Funding Hoax on us again! Here's how...

As you may know, last week an amendment providing $3 billion for
border security was stripped from the DOD appropriations bill.

We fully expect that bill to be added to the DHS funding bill
in the next few days. But even if they pass the $3 billion
funding amendment, DHS may not be required to use any of that
money for the border fence.

Not ONE DIME!

That's because of another amendment by Sen. Hutchison that says
DHS does not have to build the fence! Sen. Hutchison's staff told
us this amendment (also removed from DOD appropriations) will also
be re-attached to the DHS appropriations bill.

+ + Action Items: Help expose the Funding Hoax

I need your help to expose Congress’ Fence Funding
Hoax. We need to flood every House and Senate office with faxes
demanding action.

Specifically, we are calling for an amendment (or amendments) to
be added to the DHS appropriations bill to fully fund the
double-layer fence and directly tie that funding to the actual
building of the fence mandated by the Secure Fence Act.

I am asking you to take two actions today:

Talking Points:

1. I am disappointed that Congress has not tied the border security
funding directly to the double-layer fence mandated by the Secure
Fence Act.

2. I call on Congress to reject any amendments (such as the
Hutchison Amendment, SA 3176 to H.R. 3222) that gives Homeland
Security total discretion over whether or not to build a
border fence.

3. I call on Congress to amend the DHS appropriations bill to
fully fund 854 miles of DOUBLE-LAYER fening and directly tie
such funding to the Secure Fence Act's two-layer fence mandate.

see how the "fix was in" last year even before the Senate voted on
the Secure Fence Act -- and how Congress is trying to repeat the
funding hoax this year.

The DHS appropriations bill is in House-Senate conference right
now and could move quickly.

As Chairman of the Senate Homeland Security and Governmental Affairs Committee, I am closely monitoring the U.S. Department of Homeland Security's (DHS) efforts to prevent the illegal entry of goods and people into the United States. Recently, my committee staff visited the Southwest border to review U.S. Customs and Border Protection's (CBP) efforts to build fencing and vehicle barriers, as well as its project to install camera towers, sensors, and radars -- to create a "virtual fence" -- along several miles of the United States-Mexico border. While securing our vast borders is obviously challenging, I am concerned about the progress of these initiatives; and I will continue to work with DHS to improve their implementation.

A key need is sufficient funding; and I am pleased to report that the Consolidated Appropriations Act for fiscal year (FY) 2008 (P.L. 110-161), which was signed into law by President Bush on December 26, 2007, includes $6.8 billion for CBP to secure the borders. Within the $6.8 billion, the bill provides $1.2 billion for border security technology and infrastructure, including 370 miles of fencing and vehicle barriers and almost $15 million for additional unmanned aerial systems to patrol the border. This marks the second year in a row that Congress has fully funded President Bush's budget request for fence construction.

The Consolidated Appropriations Act also revises the Secure Fence Act of 2006 (P.L. 109-367) and gives the Secretary of DHS greater flexibility in determining where border fencing is built. The legislation requires that DHS and CBP consult with other federal agencies, state and local governments, and property owners to minimize adverse impacts on the environment and local communities before funds can be spent on fence construction. CBP has concentrated fence construction in areas it believes will have the greatest impact; it has also built double-layered fencing in those areas. As the tactics of illegal border crossers change, DHS and CBP must also continually and actively evaluate the border to determine where vehicle and pedestrian barrier construction is most necessary and effective. While they do take time, each of these steps is necessary to ensure that tax dollars are spent most effectively for this critical mission.

I'm not sure if I like the fence. Are they using eminent domain to take the land to do it?

Yes. There is a woman who is sitting on the last 4 or 5 acres of land that was granted to her family from Spain before this country was even founded. She is fighting tooth and nail to not have her land taken away.

According to Savage, Senator Kay Bailey Hutchinson put in a special provision in a bill that gave homeland security the option not to have to fund or build the wall.

Her and her staff are the one who really stabbed us in the back.
