WASHINGTON – At a time when states are struggling to reduce bloated prison populations and tight budgets, a private prison management company is offering to buy prisons in exchange for various considerations, including a controversial guarantee that the governments maintain a 90% occupancy rate for at least 20 years.

The $250 million proposal, circulated by the Nashville-based Corrections Corporation of America to prison officials in 48 states, has been blasted by some state officials who suggest such a program could pressure criminal justice officials to seek harsher sentences to maintain the contractually required occupancy rates.

"You don't want a prison system operating with the goal of maximizing profits," says Texas state Sen. John Whitmire, a Houston Democrat and advocate for reducing prison populations through less costly diversion programs. "The only thing worse is that this seeks to take advantage of some states' troubled financial position."

Corrections Corporation spokesman Steve Owen defended the company's "investment initiative," describing it as "an additional option" for cash-strapped states to consider.

Ohio's deal requires the state to maintain a 90% occupancy rate, but Janes said that provision remains in effect for 18 months — not 20 years — before it can be renegotiated. As part of the deal, Ohio pays the company a monthly fee, totaling $3.8 million per year.

the goal should be a 0% prison population in a perfect world.

maybe what the company really meant was more along the lines of they'll take over certain prisons, but would require the govt to fill them with prisoners from other publicly run prisons should the population fall below 90%? eventually transferring all administration of the prison system from the state to a private company? hard to say, there isn't much info in the article.

We already have the highest incarceration rate of any country in the world. And they just want the (in)"Justice System" to create New Criminals out of Ordinary People in order for them to get that money the Federal Reserve just "prints up". This is exactly why the Prison System should NOT be Privatized.

And this is ongoing in another thread ATM, but same thing as a Texas Judge saying that their Contracts for Red Light Cameras supercede the peoples demand to get rid of the things. They have to follow their Contract even if the People said they do NOT want that Law, the peoples wishes be damned.

Democracy only applies when it is used to restrict your rights, not the other way around.

Good point. But at the same time, States and the Feds also get money for creating criminals out of normal people. It seems the whole system needs to be scrapped in favor of something that is actually just.

That would be a lot of people! More and more, "public" prisons are moving toward the for-profit model, as AF has documented. (prison-industrial complex)
