Uniformed troops from the Texas State Guard were used for the purposes of crowd control during the Zilker Kite Festival in Austin this past weekend, with video showing the troops ordering parents and children to board school buses at the end of the event.

OK - except that the Texas State Guard is an unarmed civil defense force that belongs only to the state of Texas. If they were allowed to have weapons, that would be a state militia.

Is the argument that state militias can not be used for supporting public events?

This is what I don't like about Infowars - a non event is turned into misinformation.

We have documented innumerable examples of Posse Comitatus being violated with uniformed troops increasingly being used to conduct routine traffic stops and provide security at public events across the nation.
Posse Comitatus doesn't apply to National Guard. Lousy article.

The Texas STATE Guard is not the Texas NATIONAL Guard.

I do not care what 'they' say, the national guard/state guards are not militias. They are part of the standing army and have no business policing on our soil--or any other country's soil for that matter!

Get the kids acclimated to a police state.

The Texas State Guard is not part of the standing army.

TITLE 4. EXECUTIVE BRANCH

SUBTITLE C. STATE MILITARY FORCES AND VETERANS

CHAPTER 431. STATE MILITIA

SUBCHAPTER A. GENERAL PROVISIONS

Sec. 431.001. DEFINITIONS. In this chapter:
(1) "Reserve militia" means the persons liable to serve, but not serving, in the state military forces.
(1-a) "Servicemember" has the meaning assigned by Section 161.551, Health and Safety Code.
(2) "State militia" means the state military forces and the reserve militia.
(3) "State military forces" means the Texas National Guard, the Texas State Guard, and any other active militia or military force organized under state law.
(4) "Texas National Guard" means the Texas Army National Guard and the Texas Air National Guard.



SUBCHAPTER D. TEXAS STATE GUARD

Sec. 431.051. SUPPLEMENTAL VOLUNTEER MILITARY FORCES. To provide mission-ready volunteer military forces for use by the state in homeland security and community service activities as a supplement to the Texas National Guard, the Texas State Guard exists as part of the state militia under the Second Amendment to the United States Constitution and a defense force under 32 U.S.C. Section 109.


Sec. 431.052. COMPOSITION. (a) The Texas State Guard is composed of units the governor considers advisable.

Sec. 431.053. ACTIVE DUTY. (a) The governor may activate and call to active duty all or part of the Texas State Guard. The Texas State Guard, or part of the Texas State Guard, called to active duty has the rights, privileges, duties, functions, and authorities conferred or imposed by law on the state military forces.
(b) A member of the Texas State Guard is subject to serve on active duty at the call and by order of the governor.

Sec. 431.057. USE OUTSIDE THE STATE; FRESH PURSUIT FROM OR INTO STATE. (a) Except as provided by Subsections (b) and (c), the Texas State Guard may not be required to serve outside the state.

(b) The governor, on request of the governor of another state, may order all or part of the Texas State Guard to assist the military or police forces of that state that are defending that state. The governor may recall these forces.

What are Soldiers doing at the Kite Festival!?

Finished your homemade kite yet? There’s still time. While you’re taking a break reading this blog, let’s talk about all those guys in uniform we keep seeing at the Kite Fest. Who are those guys (and women)?

They are citizen volunteers from the Texas State Guard. To quote their website, “The Texas State Guard (TXSG) mission as a branch of the Texas Military Forces is to provide mission-ready military forces to assist State and local authorities in times of state emergencies, with homeland security and community service through Defense Support to Civil Authorities (DSCA).”

These are the men and women who volunteer to head into a hurricane or disaster while the rest of us are leaving. These brave folks have worked in hurricanes Ike, Gustav, Dolly, Rita, Katrina, and many more. The list is endless and their service unending.

O.K., so why are they at the Kite Festival? Since the Exchange Club is a (relatively small) all-volunteer organization, and because so many Austinites (a whole lot of us) come down to the park to fly kites, we need the soldiers’ help to manage the crowds during bus loading and unloading, at parking lots, and around the event. They have volunteered their Sunday to help the Exchange Club keep the Kite Fest run smoothly. Please be sure to give them a big “Thank you!” when you see them.

Now, better get back to that homemade kite!


I did not see them "ordering parents and childeren" to board busses. Made it sound like they had guns pointed at people forcing the to get on whether they wanted to or not and took them away to some place they maybe did not want to go. They were just basic shuttle busses taking them back to their cars.

Barton Springs Road will be closed from 9:00 am to 6:00 pm during the Kite Festival.

Free parking is available:
■Downtown at the State parking lots at 1604 Colorado Street
■South at the Toney Burger Activity Center at 3200 Jones Road

The shuttles come round regularly all day to these two parking lots for pick-up and drop-off. Round trip shuttle rides are $2 for persons 12 yrs and over. Well mannered dogs on leashes are allowed on the shuttles. Kids and dogs ride free.

The first shuttle departs at 9:45 am and the last shuttle going to the park leaves at 2:30 pm. Shuttles will continue taking riders back to the parking lots until 5:30pm.

No large coolers on the shuttles please, they are too big to fit (the shuttles are school buses). Kites are fine to bring on the bus!

Shuttle drivers have the authority to refuse to allow any person, animal or object on the bus.

For those driving into the Kite Festival

There is an extremely limited amount of on site parking, and wait times to enter the area can easily last 45 minutes or more. We strongly encourage you to use an alternative method of transportation to help protect our environment.


Yep- more overhype of a normal, harmless event designed to scare the paranoid.
