Fort Myers police officer shot man in back, witness says

A 21-year-old man died after a Fort Myers police officer shot him in the back at point-blank range while he lay on the ground, a witness said she told investigators Friday.
Sherita Jackson, who lives at the apartment complex where Starling Javier died, said she told Florida Department of Law Enforcement investigators she watched Javier fall to the ground in her parking lot, his gun a few feet away. Then an officer approached Javier and shot him in the right side of his back, she said.
Police said Thursday they were chasing Javier following a call about shots fired at a Metro Parkway apartment complex. They chased Javier to Central Avenue and Canal Street, where they said he fired at them as they ran after him near the Sunrise Towers apartments.
Chief Doug Baker did not return a call Friday seeking comment. Police spokeswoman Shelly Flynn declined comment earlier Friday, citing her department’s internal inquiry and the ongoing investigation by FDLE.
FDLE’s investigation is in the early stages, spokesman Keith Kameg said, and no information is yet available. Once his agency completes its work, it will hand over findings to Fort Myers police and the state attorney’s office.
Neither FDLE nor the Police Department have released the names of the two officers involved. They are on paid administrative leave pending the outcome of FDLE’s inquiry, which could take between 60 and 90 days.
Kameg declined comment on what could happen if investigators determine officers have used force inappropriately.
“It would be conjecture on our part to say how the investigation was going to go,” he said.
Kameg could not be reached to confirm Jackson talked to his agency’s investigators.
On Thursday afternoon, Sunrise Towers resident Kristie Dutra ran out of her apartment when she heard the crunch of a vehicle crash. She said she saw Javier running from the wreck, which involved his Lincoln Navigator and a tan minivan.
Dutra said she saw a police officer shoot Javier in the chest and watched Javier drop his gun. She said she never saw Javier fire the gun at the officers. The officer fired five more shots, she said.
