Carro said Mata tailored his testimony to protect his former partner, Kenneth Moreno, about what happened that night in December 2008.

"You played a different role" from Moreno, Carro said. "But for some reason you continued to carry your partner's bag through the trial ... You certainly drew the short straw when you got him as a partner."

Carro was far harsher with Moreno when he sentenced him Monday to a year in jail. The judge called Moreno a liar and immediately shipped him off to Rikers Island.

Another judge sprung Moreno a few hours later on $125,000 bail. He too is appealing his official misconduct conviction.

Moreno, 43, and Mata were acquitted in May for the rape of the bombed fashion executive.

Moreno insisted he was just trying to help the woman, but admitting he "cuddled" with her at one point during the night.

"You were in bed with a naked, intoxicated young woman," Carro scolded. "That is official misconduct."

Moreno's 29-year-old accuser was in the courtroom when he was sentenced. She was not there to witness Mata's punishment.

Both ex-cops faced up to two years in prison for making repeated trips to the woman's East Village apartment without notifying his superiors.

More legal hurdles await Moreno. A packet of heroin was found in his police locker during the rape probe, and he is due back in court next month on a drug possession charge.

If proper punishment were used on all cops who violated the law, we'd at least have much better cops although I'd still like for them to be gone altogether.

If we ELECTED cops like Sheriffs, instead of putting up with the dirtbags that are in it for the money, they would be accountable to the People come next election.

Which, of course, begs the question: Why do we even have police instead of only sheriffs and their deputies?
