A new Tennessee law makes it a crime to "transmit or display an image" online that is likely to "frighten, intimidate or cause emotional distress" to someone who sees it. Violations can get you almost a year in jail time or up to $2500 in fines.

I had read in Ronpaulforums that a wrestler or fighter had challenged Obama for a wrestling match. Secret service visited this wrestler's house. People are not allowed to take of their frustration and anger. If someday somebody throws a shoe on world leaders then the person will be arrested. Shoe cannot kill anybody.

If the shoe miss the target then also the person is arrested. Why? It is near impossible to get a direct hit from a shoe because of the shoe aerodynamics/shape.

Incredibly graphic images can be incredibly powerful. It is a visceral reaction in a person to feel threatened by a violent scene, and immediately hate or want to fight the person inflicting the violence, as witnessed recently in the Vancouver riot videos, where every body felt bad for the kid who got knocked out, only to later have many change their mind after seeing he was a prime vandalizer.

Major news networks never show blood or somebody dying, but they made an exception for Neda Agha Sultan, who was shot in the neck by Iranian paramilitaries during the green revolution. Make no mistake, that this "one time" release of an incredibly graphic and bloody snuff video released upon the American psyche was part of the campaign to whip Americans into Iranian hatred.

Now we see Tennessee trying to control who can, and cannot use this potent psychological weapon. A court case could make this acceptable, and not covered under the first amendment, so that the Federal government could ban incredibly graphic videos and images. We all know the power of the media, and how they can take anything, make it into a major issue, and then provide a solution that always seems to mean one more piece torn from the constitution.

The point is, this is more than just trying to keep people from posting gory photos. It is an attempt to give the state a monopoly on posting and broadcasting gory photos and videos, and it is incredibly dangerous.

Tennessee has it's own state Constitution which guarantees freedom of speech. This is in addition to the incorporation of the US Constitution First Amendment freedom of speech through the 14th Amendment to the States.

Tennessee has it's own state Constitution which guarantees freedom of speech. This is in addition to the incorporation of the US Constitution First Amendment freedom of speech through the 14th Amendment to the States.

Well, if they're violating the state constitution that's one thing, but the incorporation clause affecting the 1st amendment is an invention of the Supreme Court. The purpose of the amendment is to give rights to freedmen, not alter the entire constitution. Raoul Berger's Government by Judiciary is usually considered the definitive work on this topic.

Which is why I used Article 1, Section 10 instead of the 1st Amendment. The States are not allowed to make illegal today what was perfectly legal yesterday (which is the actual definition of ex post facto).

Except that view is based on Calder v. Bull. Its not based on any rational interpretation of what ex post facto means but instead of giving The State the power to actually make ex post facto law and get away with it. A retroactive punishment would be a violation of the 8th Amendment.

Good intentions. I certainly understand why they passed this. Cyber bullying. But it opens the door for so much goddamn potential abuse of our liberties, and is blatantly unconstitutional.
