Florida is a two party consent state...my understanding is that you cannot record a telephone conversation unless you get the other person's permission first.

I assume that is why this guy was arrested but the $50,000 bond and raiding of his home and confiscation of his equipment is extreme.

If you read the article pcosmar posted, it seems to say that the law doesn't include government officials due to some sort of "government sunshine" clause, which was apparently written by John McCain :D (j/k)

I would be surprised if anything lawfully is done without having a gun pointed at their head.
