Texas might come through after all. Got this email tonight:

Breaking news on the Special Session for the 82nd Legislative Session...

Here is the text of the letter from Lt. Gov. Dewhurst to Governor Perry outlining what might be ahead in a Special Session:

Dear Governor Perry,

Unfortunately, despite the very hard work and determination of the majority of Members of both the House and Senate, the Legislature was unable to pass a number of important bills, including SB 1811 needed to fund the budget, before the deadline of midnight last night.

Still, there is still an outside possibility that SB 1811 could pass the Texas Senate today with the bipartisan support of four-fifths of the Members. However, if this vote should fail ? forcing us into Special Session ? I believe that it would be in the best interest of all Texans to start tomorrow and ask you to consider including the following bills in your call:

SB 1811 – Relating to certain state fiscal matters and making necessary appropriations; providing penalties;

SB 8 – Relating to improving the quality and efficiency of health care;

SB 23 – Relating to the administration of reforms, efficiency, cost-saving, fraud prevention, and funding measures for certain health and human services and health benefits programs;

HB 5 – Relating to establishing an Interstate Health Care Compact;

HB 12 – Relating to the enforcement of state and federal laws governing immigration by certain governmental entities;

HB 272 – Relating to the operation of the Texas Windstorm Insurance Association and to the resolution of certain disputes concerning claims made to that association;

SB 12/HB400 – Relating to the flexibility of the Board of Trustees of a school district in the management and operation of public schools in the district and the flexibility for public schools to administer primary and secondary education efficiently;

HB 1937 – Relating to prosecution and punishment for the offense of official oppression by the intrusive touching of persons seeking access to public buildings and transportation; and

HB 900/SB 308 – Relating to the composition of the congressional districts for the State of Texas.

As you know, certain Senate procedures – such as the two-thirds tradition – exist to bring Democrats and Republicans together, encouraging Members to work in good faith in order to achieve positive outcomes for the people of Texas. Given that a small number of Senate Democrats have demonstrated their unwillingness to find consensus on these important legislative items, I can see no other alternative than to operate under a simple majority vote in the Special Session.

I look forward to working with you and Speaker Straus to finish the important business Texans elected us to accomplish.

A special legislative session is now being planned for SB 8, SB 23, SB 1811 and HB 6. Your action NOW can get HB 1937 added to the list.

Call (512) 463-2000 and demand HB 1937 be considered in the upcoming special legislative session.

Cool. How could anyone be in favor of it? TSA is not even catching any violent people.

It is hard to imagine anyone voting for their constituents to be naked scanned with radiation so they could go from one place to another. And if you refuse the scan, then they assault you?

That's what I would like to see.

Put Perry's feet to the fire on this. Make him make a decision to (at least) put it up for vote, if not back it.

It's not on the agenda yet, but there is hope:
In today’s meeting of the State Republican Executive Committee (“SREC”), the Texas Republican Party passed a resolution that urged Governor Rick Perry to call HB 1937 into the current special legislative session. This is the highly publicized bill by State Representative David Simpson (R-Longview) which make TSA employees liable for criminal penalties for inappropriately touching passengers during pat downs. The RLC in Texas and nationwide has taken the lead on supporting this important civil liberties legislation.

The Texas State Legislature is only allowed to convene a regular legislative session for 140 days once every 2 years. Many Texans believe the strict limitation on political “law-making” is the main reason why Texas enjoys greater freedom and economic prosperity than other states. Other Texans believe the State Legislature should only meet for 2 days once every 140 years.

The Governor has the right to call one or more “special sessions” of the State Legislature to consider emergency legislation. These special legislative sessions may last from several days to a month.

After having been implicated in the procedural death of the anti-groping bill during the regular legislative session, Lt. Governor David Dewhurst later reversed course and recommended HB 1937 for the current special session in a letter to Governor Rick Perry. To date, Gov. Perry has not called the bill, claiming he needed to determine if there was a “consensus” of support for it.

Well, today, another nearly unanimous consensus was added on to the pile of overwhelmingly strong support for the “restrain-the-TSA” legislation, as the SREC passed the following resolution without debate at its meeting in Austin, Texas. Only one committee member voted in opposition to the resolution.

All Texans should applaud the SREC for unambiguously standing up to what appeared to some to be pressure from the party establishment not to make this clear statement. Republican parties in other states are watching what happens in Texas and will be looking at how this situation develops in pursuing similar legislation in their states.

This is not the end of the story. Governor Perry still needs to get on board to support the bill. If you are in Texas, please call Governor Perry’s office at 512-463-2000 NOW and say that you are IN FAVOR of HB 1937, and that HB 1937 needs the Governor’s FULL SUPPORT and should be passed in the upcoming special session.

*There is no way Perry could kill this bill. My bet is that it passes, Perry wins brownie points with the Tea Party, is seen as the anti-establishment candidate, gets elected, and quiets the Tea Party crowd. Like Obama did in '08 with the anti-war crowd.

Gingrich had a mass resignation of his senior staff. Scuttlebutt is that many of them are jockeying for a spot on Perry's presidential ticket.

I suspect that this is a calculated move on Perry's part.

Even if the bill passes and Perry signs it into law, the "tea party" isn't just going to tow the establishment's line anymore. Americans have flat had it. Even if Perry signs the bill and seeks the GOP nomination for POTUS, we'll see if he has enough support to gain the nomination. ;)
