I wrote this in response to a National Journal article published today, that I won't link here to do the author any favors, but you can find it. Hope it helps.



JB, your entire premise is flawed because it rests on the assumption that the Constitution simply places limits on the otherwise unlimited power of the federal government. That view is in serious error. The federal government is created by the Constitution, is comprised of only the powers enumerated in the Constitution, and outside of the Constitution is an illegitimate autocracy.

The onus is instead on you, and the rest of the neoconservative wing of American politics, to demonstrate how police actions conducted unilaterally by the executive branch -- with the tacit approval of Congress, but not a declaration of war -- are somehow authorized by the Constitution.

You'd better get busy, because despite the 50 years of lawbreaking by elected officials that you cite as precedent, no one, not even a top legal scholar, has yet met that challenge.
