Three judges of the leftist Ninth U.S. Circuit Court of Appeals have joined (http://www.washingtonpost.com/politics/appeals-court-upholds-justice-challenge-on-ariz-law/2011/04/11/AFbyUKLD_print.html) the Obama administration's war against (http://www.thenewamerican.com/usnews/immigration/6294-arizona-countersues-obama-administration-on-illegal-immigration) Arizona and its people. A three-judge panel of the court upheld (http://www.washingtonpost.com/politics/appeals-court-upholds-justice-challenge-on-ariz-law/2011/04/11/AFbyUKLD_print.html) a lower federal court's decision, pursuant to a lawsuit filed by the administration, to nullify most of Arizona's now-famous immigration law.

The law, SB 1070, required police (http://www.washingtonpost.com/politics/appeals-court-upholds-justice-challenge-on-ariz-law/2011/04/11/AFbyUKLD_print.html) to check the immigration status of anyone with whom they had an otherwise lawful contact. Passed in response to the growing fiscal, educational (http://www.thenewamerican.com/index.php/usnews/immigration/5151-illegal-aliens-economic-consequences), and criminal menace (http://www.foxnews.com/politics/2010/04/29/border-states-dealing-illegal-immigrant-crime-data-suggests/) from illegal aliens (http://www.thenewamerican.com/index.php/usnews/immigration/5151-illegal-aliens-economic-consequences), the law contained other provisions, but none so highly enraged Obama and the reconquista lobby as the one permitting police to do the obvious.

Upholding the decision (http://www.azd.uscourts.gov/azd/courtinfo.nsf/983700DFEE44B56B0725776E005D6CCB/$file/10-1413-87.pdf?openelement) of federal Judge Susan Bolton, of the U.S. District Court in Arizona, the court's opinion largely relied on the damage the immigration law had done to American foreign relations, noting that foreign leaders and the United Nations had complained about it. Bolton's key concern (http://www.thenewamerican.com/usnews/immigration/6294-arizona-countersues-obama-administration-on-illegal-immigration) was that SB 1070 imposed burdens upon legal resident aliens "that only the federal government has the authority to impose"; however, the San Francisco judges went further, fretting about the criticism of the bill from Mexico and other governments.

Arizona Gov. Jan Brewer, a stalwart in defending the law, will continue fighting because the federal government, as she and Attorney General Tom Horne argued in their appeal, has abdicated its duty to control immigration.

The decision "to uphold Judge Bolton's suspension of key provisions of SB 1070," Brewer said (http://www.azcentral.com/ic/pdf/0411brewer.pdf), "does harm to the safety and well-being of Arizonans who suffer the negative effects of illegal immigration.”
