Nearly half of the members of the U.S. Senate are urging Attorney General Eric Holder to step up federal prosecutions of adult pornography.

In a letter sent to Holder earlier this week, 42 senators encouraged Holder instruct prosecutors and FBI agents to counter what the lawmakers called "the growing scourge of obscenity in America." Anti-pornography activists have noted with alarm that, under President Barack Obama, the Justice Department has not filed a single new obscenity case anywhere in the country.

"We write to urge the Department of Justice vigorously to enforce federal obscenity laws against major commercial distributors of hardcore adult pornography," the senators wrote. "We believe it is imperative that the Department, with cooperation by the FBI, investigate and prosecute all major producers and distributors of adult obscenity. We need your leadership."

"We know more than ever how illegal adult obscenity contributes to violence against women, addiction, harm to children, and sex trafficking. This material harms individuals, families, and communities and the problems are only getting worse," the senators added.

When I was young I was not aggressive. If I had slapped my friend I would have saved him from his misery. Today I am aggressive but my friend is thousands of miles away from me.

The only explanation is that Mike Lee is mormon and mormon's are hardcore about anti-pornography and anti-gay marriage (which Lee supports a federal ban on).

I think on any other issue though, Mike Lee is a strict constitutionalist

US serial killer feared loose after 8 bodies found

NEW YORK (AFP) – The discovery of eight bodies buried on a Long Island beach in the northeastern state of New York has raised suspicions here there is a serial killer on the loose.

The remains of four prostitutes, aged 22 to 27, who worked through online ads posted on the Internet site Craigslist, were discovered in December near Gilgo beach, 47 miles (75 kilometers) east of New York City. The young women disappeared on different dates between 2007 and 2010.

Investigators found three more decomposing bodies on Monday. The body of the eighth victim turned up Wednesday in the brambles that separate the beach from a nine-mile (15-kilometer) stretch of road known as Ocean Parkway.

A possible ninth victim, Shannan Gilbert, a 24-year-old prostitute from New Jersey, has been missing since May 1, 2010.

The most notorious serial killer was Joel Rifkin, 52, serving a life sentence for the murder of nine women, most of them drug addicted prostitutes, between 1989 and 1993. He is suspected of having killed 17.

Even back when the Supreme Court respected the original intent of the commerce clause, when stuff went across state lines it was different. For example the famed boxer "smiling Jack Johnson" (famous for being the first ever black heavyweight champion of the world) was prosecuted for "taking a woman across state lines for immoral purposes". Yes the prosecution was totally racially motivated. My point is that the fact that such a federal statute existed at all suggests that taking "pictures of women across state lines for immoral purposes" might also be deemed within the original meaning of the commerce clause. You want porn? Make and consume it in state. :D Seriously though it's the biggest LOL ever. Even the Chinese have given up on controlling internet porn.

I agree, but I don't think it's actually protected speech under the 1st amendment. The states should have the right to ban it if they wish to.

Only on state property (and it's a bad idea to extend property rights to any level of government...but that's a little off topic). To extend that to private property is tyranny.

We've been here before. it is free speech. Larry Flynt won his cases and there were other "obscenity" prosecutions from that era which have all been thrown out.

The overused/misused Commerce Clause is there to protect the free flow of goods and services.. not to hinder the same.

I do not believe that States (that ratified the Constitution) have any authorization to violate the rights of the people.

I agree that a federal law that bans adult pornography would violate the commerce clause and be unconstitutional. I brought up the issue of whether the states have the right to ban adult pornography, not the federal government. Article 1 Section 8 of the Constitution puts limits on what the federal government can do, not the states. The only limits on what the states can do is contained in the Bill of Rights. Now, if you want to claim that hardcore pornography is protected by the 1st amendment, then make that case. But, the issue of whether the states can ban adult pornography has nothing to do with the commerce clause.

The constitution limited the federal government primarily not the states. States have their own constitutions which may prohibit it, however.

On first amendment as applied, the SCOTUS has read it into state requirements, but it has also said obscenity isn't covered. So...

At least as i understand the Clause.
It was put in there to prevent one state from hindering trade, and the Federal Government as moderator and mediator in any conflicts between states.
Which is really the only purpose of a Federal Government.
